Description of progressowania: Supply of steel container housing Place of receipt of the ToR: Ordering Party website www.gaz-system.pl - `tenders` tab. Reservations regarding to the ToR: 1. The Contractor may ask the Employer to clarify the content of the ToR. The Employer may provide explanations or leave a request befrom recognition. 2. The Purchaser reserves the right to change the content of the Terms of Reference at any time, before the deadline for submitting offers. Any change made to the ToR by the Employer becomes part of the documentation of the procedure and is binding. 3. The awarding entity may extend the deadlinesubmitting bids taking into account the time necessary to introduce changes to the offers resulting from the change in the content of the ToR. 4. The Awarding Entity reserves the right to conduct trade negotiations regarding the criteria for the evaluation of the offers, set out in the Section Criteria for the evaluation of the offers below.proceedings: 1. The proceedings are conducted in an open tender procedure on the principles set out in the ToR. 2. An open tender is a procedure for awarding a private contract, in which all Contractors may submit bids in response to a public notice of a non-public contract, who want to take part in it. The announcement of a non-public contract in proceedings under the open tender is published on the Awarding Entity`s website. 3. In the contract award procedure, the provisions of the Act of 29.01.2004 - Procurement Law shall not applypublic (consolidated text: Journal of Laws of 2019, item 1843, as amended). 4. The Awarding Entity reserves the right to terminate the procedure without selecting the best offer without providing the reason for such action. 5. On termination of the procedure without selecting the best offer, the Purchaser withshall notify: 1) Contractors to whom SIWZ has been forwarded - in the event of termination of the procedure before the deadline for submission of tenders, 2) all Contractors who have submitted tenders - in the event of termination of the procedure after the deadline for submission of tenders. 6. The Contractor shall not claim from the Employercompensation for any damage caused in the event of the Employer exercising the right referred to in paragraph 4 above. 7.
