Tenders are invited for Social Supervision of the Sanitary Sewer System 3 Project Phases 2 and 3.

Dear Sir / Dear Madam,
1. The Municipal Company of Drinking Water and Sewerage of Guayaquil, EP EMAPAG EP (hereinafter called "the Client") has received a financing (hereinafter referred to as “the funds”) from the Agence Française de Développement (French Development Agency or “AFD”), to finance the cost of Project 3 of Sanitary Sewerage System Phases 2 and 3, and intends to use a part of these funds to make eligible payments under this Agreement for which this Request for Proposals is issued.

2. EMAPAG EP is being structured to manage Project execution, for which reason the implementation of a Project Executing Unit (UEP) within EMAPAG EP, dedicated to Project execution, is planned.

3. In this context, EMAPAG EP issues this Request for Proposals (SP) to contract the services of an external Consultant, hereinafter designated as "the Consultant", to provide the following consulting services (the "Services"): Social Supervision of the Sanitary Sewer System 3 Project Phases 2 and 3.

4. The Consultant shall be a natural person (individual Consultant) who can provide the required services and who is eligible as specified in Section V. Eligibility Criteria of this SP.

5. The Consultant must include in his proposal complementary documentation that is specified in Section VII Terms of Reference, which will not be qualified, however, they will be considered as essential requirements to participate in the qualification process.

6. The term of the services is 33 months from the notification of the start of work.

7. With the express consent of the AFD, there has been no Call for Expression of Interest and a pre-selection of candidates prior to this SP, which is therefore open and directed to eligible Consultants (Individuals) as specified in the Annex Declaration of Integrity, Eligibility and Environmental and Social Commitment of this invitation that must be signed and sent along with the proposal.

8. This Request for Proposals includes the following documents:
Section I - Invitation Letter and Instructions to consultants;
Section II - Proposal Presentation Form
Section III - Model / content of the Technical Proposal;
Section IV - Model / content of the Financial Proposal;
Section V - Eligibility Criteria;
Section VI - AFD Rules - Fraudulent and Corrupt Practices - Environmental and Social Responsibility;
Section VII - Terms of Reference;
Section VIII - Standard Contract Form.

9. The Proposal will include the following:
a. Technical Proposal
i. The Proposal Presentation form,
ii. The Annex - Declaration of Integrity, Eligibility and Environmental and Social Commitment duly signed,
iii. The Technical Proposal (a) the Methodology and work plan to carry out the Services and b) the Curriculum Vitae of the Expert)
b. The Financial Proposal.
The Consultant must sign the original cover letters on the required form, both for the Technical Proposal and for the Financial Proposal and must list and initial all the pages of both.
10. Proposals must be submitted physically, no later than 3:00 p.m. on April 30, 2020 (or at any extension of this deadline), as follows:
a. The Technical and Financial Proposals must be duly initialed, foliated and numbered and will be delivered separately in sealed envelopes, with the following labels:

The envelopes containing the Technical Proposal and the Financial Proposal must be placed in an outer envelope, which must also be sealed. The following indications must appear on this outer envelope:

The Consultant will present:
- Technical Proposal: One (1) original physical document + one (1) copy digital document (CD or pendrive)
- Proposal Financial: One (1) original physical document + one (1) copy digital document (CD or USB key)

b. The opening minutes of the Proposals and the notification of the selected Consultant will be published on the page www.emapag-ep.gob.ec.

11. If necessary, additional clarifications may be requested no later than seven (7) days before the date of submission of Proposals to the following email address: uepafd@emapag-ep.gob.ec.

12. Proposals must remain valid for ninety (90) calendar days after the submission deadline.

13. Consultants will assume all costs associated with the preparation and presentation of their Proposal, and EMAPAG EP will not be responsible for such costs, regardless of the way in which the selection process is carried out or the result thereof.

14. Proposals must be submitted in Spanish language.

15. The Consultant shall express the price for his services in Dollars of the United States of America, which will also be the only payment currency of the Contract.

16. The amounts payable by the Client to the Consultant under the Contract will be subject to national taxes. Information about the tax obligations of the Consultant in the Republic of Ecuador can be found on the page http://www.sri.gob.ec/web/guest/detalle-de-obligaciones-por-contribuyente. The Financial Proposal must estimate separately the taxes, fees, rates, encumbrances and other fiscal charges applicable in the Client`s country in accordance with the Law applicable to the Consultants (who is not a national or permanent resident in the Client`s country). The Consultant is responsible for all tax obligations arising from the Contract unless point 24 of this Section I indicates otherwise.

17. The opening of the Technical Proposals will be made in a public session, with the presence of the bidders who wish to attend. The opening will take place at the same address as the physical presentation of the Proposals. The opening date will be the same as the deadline for the submission of Proposals indicated in point 10 of this Section I.

18. When the Technical Proposals are opened, the following will be read: (i) name of the Consultant, (ii) presence or absence of the documents that the Proposal must comprise, and (iii) any other information deemed relevant.

19. The opening of the Financial Proposals will be made in a public session, with the presence of the bidders who wish to attend. The financial proposals will be opened after the issuance of the technical evaluation report with the bidders who have passed the minimum qualification. The opening will take place in the same direction as for the presentation of the Technical Proposals. When the Proposals are opened the following will be read: (i) name of the Consultant, (ii) the presence or absence of the documents that the Proposal must comprise, (iii) the total amount (without taxes) of the Financial Proposal and (iv ) any other information deemed relevant.

20. The qualification and selection process will be carried out by a Qualification and Selection Committee. The qualification and selection process will be submitted to the No Objection of the AFD.

21. The Consultant will be selected based on the Quality and Cost Based Selection (SBCC) method described in §2.3.3 Opening and Evaluation of the proposals of the “Procurement Norms for Contracts Financed by AFD in Foreign Countries” Available on the AFD website: www.afd.fr https://www.afd.fr/sites/afd/files/2017-09/normas-adquisiciones-contrato-financiados-afd-paises-extranjeros_0.pdf ( hereinafter referred to as "the Standards").

22. In evaluating the Proposals, the quality of the Proposal will prevail over the cost, based on a weighted score between the Technical Proposal and the Financial Proposal.

23. The criteria and the allocation of points that will be taken into account for the evaluation of the Technical Proposal are:

The evaluation sub-criteria of the aforementioned criteria are described in the Annex 4 of Section VII-Terms of Reference of this SP.
- The minimum technical score for criteria (1) & (2) together, required to pre-qualify is: [65] out of a total of [80] points. Technical Proposals below this minimum limit will be discarded from this first stage of the technical evaluation. For the others, the proposed Consultant will be called for an interview. The objective of the interview will be to assess the suitability of the proposed Consultant with the needs of the Client and the Services to be performed, as well as to clarify the Technical Proposal. Interviews for applicants residing outside of Ecuador may be carried out at one of the AFD group agencies through a video conference with EMAPAG EP or by Skype or any other visual communication system.
- The minimum technical score for criteria (1), (2) & (3) gathered, required to qualify is: [80] out of a total of [100] points. Technical Proposals below this minimum limit will be discarded from this second stage of the technical evaluation.
- The financial evaluation is carried out in a second stage (except for the rejected technical proposals) after the interviews. After verifying them, the financial proposals will be classified according to the following criteria: the lowest proposal gets a rating
