The observation of electoral processes since 2013 has led partners of the Malian state to make recommendations for a better organization of elections. The political and civil society actors also demanded that the Government take into account concerns aimed, among other things, at a better representation of Malians from the diaspora in the National Assembly.

Taking into account these various requirements, the Malian State requested and obtained from the Constitutional Court an opinion for the purpose of extending the mandate of the deputies to the National Assembly because of the need to carry out these reforms, which are now necessary to him to know:

· Re-reading of the law establishing local authorities in Mali;

· Re-reading the law on territorial organization in Mali;

· The revision of the organic law bearing number, conditions of eligibility, the system of ineligibility and allowances of deputies to the National Assembly.

It is against the technical requirements of this vast project of electoral and constitutional reforms that the National Assembly of Mali organizes, with the financial support of the MINUSMA, the recruitment of an international consultant in order to support it technically in the taking in charge and the efficient treatment of the texts that will soon be transmitted by the Government.




Duties and Responsibilities

Under the responsibility of the President of the National Assembly and under the supervision of the chairpersons of the parliamentary committees, the Principal Consultant shall, during his / her mission, carry out the following tasks:

· Assist the technical committees of the National Assembly in establishing the state of play of the political, institutional and constitutional reforms that apply as a priority in Mali;

· Propose an efficient strategy for taking them into account by legislative or even constitutional means, paying particular attention to the recommendations of the national dialogue on Mali;

· To the stipulations of the Agreement for peace and reconciliation in Mali resulting from the Algiers process, stipulations relating in particular to the management by the population, of their affairs on the basis of the principle of the free administration, by direct universal suffrage for the election of the members of the territorial assemblies, including the heads of local executives, by direct universal suffrage for the election of the President of the Regional Assembly, head of the regional executive, for the creation of a second chamber for the Parliament Mali, the increase in the number of electoral constituencies and the opening of the High Council of Communities to the representatives of traditional notabilities, women and young people;

· To contribute, through his knowledge of the law, to the re-reading of the constitution, the re-reading of the law establishing local authorities in Mali, the review of the law on territorial organization in Mali and the review of the law on the number, conditions of eligibility, the system of ineligibility and allowances of deputies in the National Assembly;

· Propose to the members of the parliamentary committees, the best formulations that allow, in accordance with the law on gender, to take into account the effective appointment of women to elective and nominative functions as well as the modification of the voting system for the legislative elections, the substitute for the deputies to the National Assembly, the campaign time between the two rounds of the presidential election, the financing of the electoral campaign, the organ of regulation of the communication during the electoral period, the creation of a permanent single organ the management of elections, the increase of the participation rate of the population in elections;

· Evaluate the political and financial implications of the various reforms;

· Establish and maintain collaborative relationships with colleagues and counterparts in the UN common system, government representatives, civil society actors, armed forces and law enforcement, academic and research institutions, and other national and international partners on issues of information sharing;

· Support and cooperate with partners to develop strategies and action plans to address policy and reform challenges in pursuit of the objectives of this recruitment;

· Perform other related duties as required.

The expected results of the consultation are:

· The list of elements of political, institutional and constitutional reform contained in the Agreement for peace and reconciliation in Mali resulting from the Algiers process is drawn up by the members of the technical committees of the National Assembly;

· Documentary research and the identification of the different reports of civil society actors, political parties, and international partners, concerning the electoral process in Mali and the good governance of the institutions are effectively carried out;

· The legal assessment of the relevance and impact of the recommendations included in the reports referred to above is ensured;

· The analysis of the recommendations, including cultural and civilizational data, is produced and made available to the parliamentary committees;

· The consultancy report must be provided at the end of its mission.

Required Skills and Experience

Education:

· Doctorate degree in political science, public law or equivalent in electoral matters or constitutional law, international economics, international relations, public law or a related field;

· A second-level university degree (Master) with two additional years of qualifying experience may be accepted in lieu of a post-graduate degree.

Experience:

· At least fifteen (15) years of professional experience, at various levels of responsibility or higher, in the field of legislation, constitutional law, constitutional reforms, elections or public law education acquired in at least one post-conflict country is required;

· Strong experience in political analysis is required. Strong experience in the field of electoral operations is required;

· Good knowledge of reporting techniques is required;

· Experience in providing advice to national authorities on the implementation of the legal framework in areas such as the evaluation and amendment of legislative or constitutional texts is required;

· Experience in a conflict or post-conflict context is required. Experience in managing a diverse team is required;

· A good knowledge of the United Nations system is desirable;

· Good control of the political situation in Mali is desirable;

· A good knowledge of the Malian political actors is desirable;

· Experience working with MINUSMA would be an asset.

Linguistic knowledge :

· English and French are the working languages ??of the United Nations. For the post advertised, fluency in French is required;

· Knowledge of English is desirable.
