In March 2017 the Juvenile Protection Law was passed by Presidential decree, bringing into force measures, which aim for children in conflict with the law to be diverted from the formal justice system, for mediation measures to reduce criminalization, and rehabilitative and restorative measures to be in place. These aim to ensure a child-friendly justice system, which upholds to the UNCRC principles of the best interests of children, and detention as a last resort.
The Juvenile Protection Law (Article 23) specific judicial responsibilities are assigned to the Prosecutor under the Attorney General's Office to allow for mediation for violations. This authority can be delegated by the Prosecutor.
In 2017 UNICEF supported the Ministry of Social Development (MOSD), through the National Committee for Juvenile Justice, to develop a National Strategic Plan for the justice for children. This plan outlines the key areas of support required to implement the law, and under 2.3 of the plan an activity includes the development of a national policy for mediation, measures, diversion and alternatives to detention.
UNICEF support through an NGO mapped potential alternative to detention organisations, which could provide alternative to detention measures including mediation. The mapping was followed by a capacity assessment to identify the needs of the hosting organisations, the type of support needed and their absorption capacity. Currently efforts are underway to finalize the assessment and a piloting plan.
The purpose of this consultancy is to develop mediation guidelines including a monitoring and implementation criteria and a mediators training package for children in conflict with the law in Palestine.
How can you make a difference?
Major Tasks to be accomplished:
· - Undertake a desk review on the current situation of children in conflict with the law in Palestine, the legal framework and the application of mediation.
· - Identify best practices from the region and the world to be represented to and discussed with the national stakeholders.
· - Conduct interviews with key justice actors including the Family and Juvenile Protection Police, the Juvenile Prosecution, the Child protection counselors and CSOs.
· - Conduct focus group discussions with the Juvenile police, juvenile prosecutors and child protection counselors from the different governorates and assess their experience in mediation.
· - Facilitate four consultative meetings and workshops to discuss the potential model for mediation and the draft guidelines.
· - Draft the mediation guidelines and the mediators toolkit.
· - Oversee one capacity building workshop for mediators (including the juvenile prosecution, the juvenile police and the child protection counselors) using the developed toolkit.
Estimated duration of contract and Tentative Dates
Duration: 35 working days over a period of 3 months
Dates: 1 November 2018- 1 February 2019

The work is envisaged to take place with an international expert working jointly with a national expert.
International consultant should have:
Qualifications: Advanced university degree (Master's Degree or equivalent) in law, international human rights, humanitarian law or other related field.
Experience: At least 10 years of experience in the area of justice for children, ideally with a focus in humanitarian and developing country context settings. Experience as a juvenile prosecutor ideally required.
Language: Excellent English language skills, Arabic is an asset
National consultant should have:
Qualifications: Advanced university degree (Master's Degree or equivalent) in law, international human rights, humanitarian law or other related field.
Experience: At least 5 years of experience in the area of justice for children.
Language: Excellent Arabic and English skills are required.
