Assignment Description

The World Bank is seeking a Short-Term (individual) Consultant (STC) to support it in policy dialogue toward promotion of broadband connectivity for the Republic of Moldova and engage with the Ministry of Economy and Infrastructure (MEI) to analyze laws and bylaws, related regulatory frameworks, standards, and procedures that determine the conditions and circumstances when electricity suppliers must restore electricity supply for the base stations of the mobile electronic communications networks. In addition, the STC shall identify options to establish priority restoration of the power supply for these stations, as well as for other sites of major importance. He/she will be carrying out a study on the uninterrupted supply of electricity to the base stations of the mobile electronic communications networks, in line with art. 3.7 from Action Plan on the implementation of the Broadband Development Program for 20182020 (approved by Government decision no. 629 of July 5, 2018).

Shortlisted consultants will be invited to respond to a Request for Proposal. Contract awards will be made in accordance with the World Bank Group Procurement Policies and Procedures.

Terms of Reference for a Short-Term Consultant to review of legislative frameworks, standards, procedures and regulations that are applicable to ensuring uninterrupted supply of electricity to the base stations of the mobile electronic communications networks

OBJECTIVE OF THE ASSIGNMENT:
The World Bank is seeking a Short-Term (individual) Consultant (STC) to support it in policy dialogue toward promotion of broadband connectivity for the Republic of Moldova and engage with the Ministry of Economy and Infrastructure (MEI) to analyze laws and bylaws, related regulatory frameworks, standards, and procedures that determine the conditions and circumstances when electricity suppliers must restore electricity supply for the base stations of the mobile electronic communications networks. In addition, the STC shall identify options to establish priority restoration of the power supply for these stations, as well as for other sites of major importance.
He/she will be carrying out a study on the uninterrupted supply of electricity to the base stations of the mobile electronic communications networks, in line with art. 3.7 from Action Plan on the implementation of the Broadband Development Program for 2018-2020 (approved by Government decision no. 629 of July 5, 2018).
BACKGROUND AND CONTEXT:
The uninterrupted supply of electricity to the base stations of the mobile electronic communications networks plays a critical role in the normal operation of these stations and the provision of publicly available electronic communications services, specifically broadband access and emergency 112 number access. The base stations have autonomous sources of power supply (electric batteries and diesel-based generators). These alternative sources ensure the operation of the base stations when power supply is disconnected, but the autonomous service life is limited to a few hours and differs from station to station. If the power supply is not restored within the given period, the base station turns off, interrupting provision of mobile electronic communications services for the covered area.
In the several meetings with providers of mobile electronic communications networks and services, they expressed the need to revise the energy regulatory acts by including the base stations in the category of consumers, for which restoring the electric supply should be a priority.
In this context, the World Bank is seeking the services of a legal consultant, to analyze the laws and bylaws, related regulatory frameworks, standards, and procedures that are applicable for the ensuring uninterrupted supply of electricity to the base stations of the mobile electronic communications networks across R. of Moldova. In addition, the consultant will perform analysis of the institutional framework of relevant public institutions and regulatory bodies to ensure alignment with the mandate and capacity of the respective institutions/agencies, to resolve issues that may arise due to the recommended actions derived from this activity.
DUTIES AND RESPONSIBILITIES:
Analysis of the Law on electricity no.107 of May 27, 2016, as well as other laws and bylaws, regulatory frameworks, standards and procedures, that are applicable for ensuring the uninterrupted supply of electricity to the base stations of the mobile electronic communications networks, including but not limited to:
o Law regarding energy no.174 of September 21, 2017;
o Law on the promotion of the use of energy from renewable sources no.10 of February 26, 2016;
o National Agency for Energy Regulation Decision regarding the approval of the Technical Norms of the Electric Transport Networks no.266 from November 20, 2007;
o National Agency for Energy Regulation Decision on the approval of the Regulation for the supply and use of electricity no.393 from December 15, 2010;
o Rules of technical operation of power plants and networks, 1989 edition in Russian (??????? ??????????? ???????????? ????????????? ??????? ? ?????, ??? 1989);
o Rules for electric installations, 7th edition/(NAIE);
o Regulation on the measurement of electricity for commercial purposes no.382 from July 02, 2010;
o Electricity Market Rules no.212/2015 from October 09, 2015;
o Regulation on construction/reconstruction of power plants, no.436 from April 26, 2004;
o Other laws and bylaws related to implementation of provisions set out in the above-mentioned laws.
The consultant should thus conduct a study on the legal framework to provide uninterrupted supply of electricity to the base stations of the mobile electronic communications networks, according to the art. 3.7 from Action Plan on the implementation of the Broadband Development Program for 2018-2020 (approved by Government decision no. 629 of July 05, 2018). Specific tasks to be completed include:
• Identify applicable laws, regulations, standards and codes, and procedures for the ensuring uninterrupted supply and restoration of supply of electric power to the base stations of the mobile electronic communications networks;
• Analyze the Law regarding electricity no.107 of May 27, 2016, related legal and regulatory framework, identify provisions/articles to be amended; propose amendments and recommendations by including the base stations in the category of consumers, for which restoring the electric supply is done on a first priority basis;
• Analyze functions and institutional structure of the public entities involved.
DELIVERABLES
Report in English, on analysis of laws and bylaws, related regulatory frameworks, standards, and procedures that are applicable for the ensuring uninterrupted supply of electricity to the base stations of the mobile electronic communications networks. The report shall include detailed analysis of the gaps identified during the analysis of the frameworks assessed, impact of gaps identified, proposed amendments to relevant laws/bylaws and regulations, and recommendations for effective enforcement of the amendments.
This report should identify provisions/articles needing amendments; recommendations for including the base stations in the category of consumers with prioritized electric supply.
PERIOD OF THE ASSIGNMENT:
The consultant is hired for a duration of 35 working days, from 1st of April 2019 to 30 of June 2019:
• 4 days for identification of study cases, relevant legal and institutional structures and acts relevant to each case;
• 15 days for analysis of the relevant legislative framework and identification of gaps/relevant provisions for amendment, including relevant meetings and consultations with stakeholders involved;
• 8 days for preparation of draft provisions amending relevant laws and bylaws, including recommendations for effective enforcement of the law;
• 8 days for drafting and finalizing the report, incorporating feedback by the MEI team.
REQUIRED QUALIFICATIONS:
We are looking for a consultant with:
- Master-s Degree in legal studies, from a reputed, recognized university.
- At least 5 years of working experience in fields related to energy supply; with desirable experience working in the electronic communications sector, proven expertise in administrative law and legal drafting.
- Previous experience of working on legislative process (amendments to the laws) would be an asset.
- Professional proficiency in English and Romanian is mandatory requirement.
REPORTING:
The Consultant will report to Siddhartha Raja, Senior ICT Policy Specialist at the World Bank in Washington DC.
