Assignment Description

SUPPORTING ISNPECTIONS REFORM IN GREECE IN THE OCCUPATIONAL HEALTH AND SAFETY DOMAIN

The World Bank is supporting the Government of Greece (GOG) in undertaking an ambitious and comprehensive inspection reform which covers all inspections affecting businesses focusing on lifting the administrative burden, improving regulatory outcomes and facilitating investment.
Throughout the inspections reform, the GoG is adopting inspection tools as stipulated in the Greek Law on Supervision (L. 4512/2018). Within this context WB is supporting GoG by: providing guidelines for the adoption of inspection tools; supporting the development of inspection tools (inspection checklists, complaint management system, risk assessment system, enforcement management model, ICT) in priority domains; delivering training and capacity building to inspectors; and supporting participation of the private sector in the reform. One of the priority regulatory domains covered by this project is Occupational Health and Safety.
The World Bank is hiring an international firm with experience on supervision of economic activities in the domain of Occupational Health and Safety (OHS) to support the development of:
the full range of tools foreseen by the 4512/2008 Greece inspections framework law (hereinafter the Law) including: (i) risk criteria for risk assessments and risk-based planning methods (e.g. number of inspections per year, resources committed, annual targets to increase compliance), (ii) selected checklists for inspectors, (iii) complaints management system, (iv) enforcement management model including both the legal and operational aspects (e.g. how to reform sanctions consistent with a risk-proportional approach, how to provide detailed operational guidance to inspectors to ensure consistency, proportionality and transparency in enforcement decisions and how to ground enforcement decisions on the severity of the violation from a risk perspective);
relevant training materials for inspectors;
a guidance note for businesses.
For all the above areas, the support will primarily consist of a review of documents/outputs produced by the World Bank team, which will set out findings and recommendations to strengthen the operational framework and tools for the Greek Labor inspectorate based on best practices. The review will refer to specific examples from good international practice (in particular EU related) that can guide the development of practical solutions in the above-mentioned operational framework and tools.
The proposal will be evaluated based on multiple criteria. In depth practical experience in regulating OHS, conducting inspections as well as outreach to the business community is required. Doing so or having done so as a regulator will be considered an advantage. The firm should possess, in particular:
1. A demonstrated track record in the implementation of Occupational Health and Safety inspections reforms, in particular related to:
a) The overall legislative framework;
b) Planning and conducting inspections;
c) Complaint management system;
d) Enforcement management model;
e) Mainstreaming risk management into an inspectorates operations in OHS.
2. Proven experience in communication and consultation of Occupational Health and Safety requirements with the affected business community;
3. A team comprising experts with significant hands-on experience in supervision activities in the OHS domain covering all aspects listed above;
4. Experience in and knowledge of Occupational Health and Safety regulation and supervision activities in other EU member states;
5. Ability to tap a network of professionals with expertise in OHS, and ability to access regulators in other European jurisdictions to document approaches, practices and tools in the OHS domain in select EU jurisdictions.
The timeline for implementation is estimated from February 2021 until October 29th, 2021 with possibility of extension.

Qualification Criteria

Terms of Reference for
Design and implementation Support of Inspections Reform in the Field of Occupational Health and Safety in Greece

I. Context
The Government of Greece (GOG) is undertaking an ambitious and comprehensive inspection reform which covers all inspections affecting businesses focusing on lifting the administrative burden, improving regulatory outcomes and facilitating investment. The World Bank (WB) is supporting this reform, which is financed by a trust fund from the European Union.
Additional efforts are needed to ensure full implementation of the “Greek Law on Supervision”(L. 4512/2018) which sets the main principles for the inspections reform and mandates the adoption of inspection tools through secondary legislation aiming at (i) implementing risk-based inspections; (ii) improving compliance; (iii) mitigating and managing risks to health, environment, consumer rights and other public goods; and (iv) supporting a sound economic development to attract investment and improve competitiveness in all economic sectors, with a focus on priority domains.
