2. The Contractor`s use of technical capabilities or economic situation of other entities:

2.1. The contractor may to confirmmeet the conditions for participation in the procedure, where appropriate, and in relation to a specific contract, or part thereof, rely on the technical or professional capacity or financial or economic standing of other entities, regardless of the legal nature of the legal relations with it.

2.2. The contractor, which relies on the abilities or situation of other entities, must succeedshow the contracting authority that in carrying out the contract he will have the necessary resources of these entities, in particular presenting the undertaking of these entities to make available to him the necessary resources for the purposes of implementing the contract.

2.3. The Awarding Entity assesses whether technical or professional capacities made available to the Contractor by their entities or their financial or economic situation, lawsuitthey are seeking to demonstrate by the Contractor that they have met the conditions for participation in the procedure and examines whether there are grounds for exclusion against this entity, as referred to in art. 24 paragraph 1 points 13-22 and para. 5 item 1 of the Public Procurement Law

Grounds for exclusion referred to in art. 24 Public Procurement Law

The following are excluded from the public procurement procedure:

1. Contractors who have not demonstrated compliance with the conditions for participation in the progressiveniu or have not shown no grounds for exclusion;

2. Contractors who do not show that they do not have the conditions referred to in art. 24 paragraph 1 point 13-23 Pzp;

3. Contractors who are subject to the conditions referred to in art. 24 paragraph 5 point 1 Pzp, i.e. :

3.1. The contractor in relation to which the liquidation was opened, in the arrangement approved by the court in the restructuring proceedings is palleged satisfaction of creditors by the liquidation of his assets or the court ordered the liquidation of his assets pursuant to art. 332 paragraph 1 of the Act of 15.5.2015 - Restructuring Law (i.e. Journal of Laws of 2019, item 243, as amended) or whose bankruptcy was announced, with the exception of the Contractor who, following the declaration of bankruptcy, concluded an arrangement approved by a final decision court, if the agreement does not foreseegrants satisfaction to creditors by liquidation of the assets of the bankrupt, unless the court ordered the liquidation of his assets under art. 366 section 1 of the Act of 28.2.2003 - Bankruptcy Law (i.e. Journal of Laws of 2019, item 498).

List of statements or documents confirming compliance with the conditions for participation in the progressand no grounds for exclusion

1. Each contractor must provide a current statement as at the date of submitting the offers in the form of a single European order document (EAT) to the extent indicated in Annex 7 to the ToR. The information contained in the statement will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure.

2. In the case ofFree application for the contract by the contractors, the declaration referred to in item 1 (EAT) is made by each of the contractors jointly applying for the contract. These documents confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion to the extent that each of the contractors shows that they meet the conditions for participation in the procedure and no grounds for exclusion.

3. The Contractor, who refers to the resources of other entities in order to demonstrate the lack of existence of grounds for exclusion and compliance with them, to the extent that they refer to their resources, the conditions for participation in the proceedings also submits the declarations referred to in point 1 (EAT) regarding these entities.

4. If the Contractor relies on the abilities and situation of other entities, regardless of the natureThe contractor is obliged to prove to the contracting authority that he will have the necessary resources in a manner enabling proper performance of the contract and that the relationship between the contractor and these entities guarantees real access to their resources. To this end, the contractor will submit a written undertaking (original document) of these entities to be handed over to himposition of the necessary resources for the period of using them when performing the order. The content of the third party`s obligation should specify: who is the entity receiving the resources, the scope of the contractor`s resources available to another entity, how the contractor uses the resources of another entity when performing the order, the scope and duration of the participation of another entity in the performance of the order.

5. Provy when completing the EAT form, the Contractor may use the instructions for completing it on the website of the Public Procurement Office.
