Equipment supply contract for the implementation of the research project according to the subsidiary contract no. 22671 of August 8, 2018, having as object "Identification of prognostic biomarkers and prediction of the response to therapy in mammary tumor pathology" and the subsidiary contract No. 22672 of 8.8.2018, "Identification of aprognostic biomarkers and prediction of response to therapy in uterine cervical pathology "- Brachytherapy cervical installation and breast brachytherapy facility

Information and formalities necessary for evaluating if requirements are met:

1) Candidate / tenderer, third party supporter, the subcontractors will prove the non-compliance with the provisions of Article 164 of Law 98/2016, art. 165 of Law 98/2016, art. 167 of Law 98/2016, the way of accomplishment is the presentation of the DUAE, according to art. 193 par. (1) of Law 98/2016. With the DUAE, a statement will be filed regarding the non-compliance with the provisions of art. 59-60 of Law 98 / 2016.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted at the request of the authorityacting only by the bidder ranked first in the interim ranking made at the completion of the bid evaluation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are: (i) Tax certificates issued by local public administration bodies and ANAF (for headquarters, secondary offices - if any, and all work points for which there arepayment obligations) in order to prove the fulfillment of the payment obligations to the local budget and the consolidated general budget; documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement, if applicable. For economic operators that are not registeredin Romania, the contracting authority will accept as sufficient and relevant to prove that the tenderer / associate / subcontractor / third party does not fall into one of the situations provided for in art. 164, 165 and 167 any document considered to be edifying in this respect in the country of origin or in the country in which the tenderer is established, such as certificates, recordsjudicial or other equivalent documents issued by the competent authorities of that country. If in the country of origin or in the country in which the tenderer / candidate is established, no documents of the kind provided in paragraph (1) or the respective documents do not cover all the situations stipulated in art. 164, 165 and 167, the contracting authority will accept a notary statement in needlesStress Judiciary of the economic operator and of the members of the management or supervisory body of the operator or of those having the power of representation or control within the operator, as is apparent from the founding body issued by the ONRC.

The bidders / tenderers associates, third parties and subcontractors should not be in the foreseeable situationit's at art. 60 of Law no. 98/2016 on public procurement. The declaration will be completed within the DUAE by all the economic operators participating in the procedure: Associate bidders / bidders, third party suppliers and subcontractors.
