1. The subject of the order is the delivery of an X-ray device for scanning vehicles with assembly and installation, as well as the construction of infrastructureat the border road crossing point in Korczowa.

1. The subject of the order is the delivery of an X-ray device for scanning vehicles with assembly and installation as well as the construction of an accompanying infrastructure at the road crossing point in Korczowa.

2. The subject of the contract includes in particular:

1) delivery, assembly and installation of an x-ray device for x-ray screeningtrucks, buses and passenger cars, along with the necessary software and licenses for installed computer programs;

2) construction design including obtaining a building permit;

3) performing author`s supervision during the construction of the accompanying infrastructure, assembly and installation of the X-ray device;

4) construction of accompanying infrastructure;

5) reconstruction indicatedby the Contracting Authority, the location of the X-ray device along with the delivery of the required equipment;

6) launching the X-ray device and performing all required tests and measurements in the presence of the Employer`s representatives;

7) training of the Employer`s employees;

8) provision of warranty services.

3. X-ray device, referred to in paragraph 2 point 1), is a completely safe device for observant and environment - meeting all radiation safety requirements contained in relevant Polish laws and norms (Atomic Law and implementing regulations) and European and international law (including: International Atomic Energy Agency, International Commission for Radiological Protection-ICPR60 and World Health Organization) .

4. Detailed opis the subject of the order and the manner of its implementation includes:

a) Functional and Technical Specification for the X-ray device (Annex J to the ToR),

b) Functional and Utility Program (Annex K to the ToR),

c) Template Agreement (Annex I to the ToR) ). In the absence of a section regarding the absence of grounds for exclusion:

1. Contractors who can not be excluded can apply for the contractpursuant to Article 24 of the Act of 29.1.2004 - Public Procurement Law (Journal of Laws of 2018, item 1986), hereinafter referred to as the Act. The ordering party applies in the proceeding the grounds for exclusion, referred to in art. 24 sec. 5 points 8 of the Act, does not apply the other grounds for exclusion referred to in art. 24 sec. 5 points 1-7 of the Act

2. The Contractor shall attach the offer to the offer that is valid as of the date of the offerrt Uniform European Order Document hereinafter referred to as "EAT" to the extent indicated by the Employer in the ToR confirming that the Contractor is not subject to exclusion and fulfills the conditions for participation in the proceedings. 4. A contractor who relies on the resources of other entities to demonstrate non-existence towards the grounds for exclusion and compliance, in so far as they relate to their resources, In the course of the proceedings, also EIN regarding these entities is submitted.

5. In the event of a joint application by the Contractors, the EAT shall be submitted by each of the Contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates fulfillment of the conditions for participation in the proceedingsand no grounds for exclusion.

6. The Contracting Authority indicates that the Contractor may limit itself to completing the section α in part IV of the Eight and obey any of the remaining sections in Part IV, ONE

7. In order to confirm the absence of grounds for exclusion of the Contractor from participation in the proceedings, the Employer will request the following documents:

1) information from the National Criminal Register in the scope specifiedin Article 24 sec. 1 item 13, 14 and 21 of the Act,

2) certificate of the competent head of the tax office,

3) certificate of the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security contributions or health;

4) Contractor`s declaration for bto issue to him a final court judgment or final administrative decision on default of payment of taxes, fees or social security or health insurance contributions, - 5) Contractor`s statement about the lack of a ruling against him as a precautionary measure prohibiting applying for public orders; - 6) statements Contractors about not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2017 item 1785, as amended);

7) statements of the Contractor about affiliation with or lack of belonging to the same capital group ; in the case of being part of the same capital group, the contractor may submit together with the statement documents or information confirming that connections with another contractor will not be carried outto distort competition in the proceedings.

8. Contractor who has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in paragraph 1 respectively. 7 submits the relevant documents specified in the order documents.

1. To confirm compliance byThe Contractor of the conditions of participation in the proceedings concerning the economic or financial situation, the Employer will request the information of the bank or cooperative savings and credit fund confirming the amount of financial resources held or creditworthiness of the Contractor in the period not earlier than one month before the deadline for submission of tenders. If for justified reasons, the Contractorcan not submit the documents required by the Contracting Authority, referred to in paragraph 2, the Employer allows the Contractor to submit other documents referred to in art. 26 par. 2c of the Act

1. EAT should be submitted electronically. Detailed information can be found in Chapter XII of the ToR.

2. The Contractor joining the tender is obliged to make a bid bond in the amount of PLN 300, 000 (three hundred thousandPLN).

3. The bid bond can be paid in one or several of the following forms: - 1) in cash, - 2) bank guarantees or credit and savings bank guarantees, however, the surety must be a cash guarantee,

3) bank guarantees,

4) guarantees insurance, 5) sureties granted by entities referred to in art. 6b par. 5 point 2 of the Act ofNovember 9, 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2019, item 310).

4. The bid bond must cover the period of being bound by the offer and must not contain any restrictions contrary to the Act, in particular limiting the possibility of exercising the rights specified in art. 46 ust. 4a and 5 of the Act
