Reference Number: 4-2019

Development of technical project execution details, technical verification of project, technical assistance on hairthe execution course the execution of the "Design and execution services for the objectives of lot 1 and lot 2". The total estimated value of the contract is RON 35 712 549.21 excluding VAT, which is made up of:

(a) wavethe costs of the design and technical assistance services (Chapter 3 of the quotation) = 2 112 423.69 RON excluding VAT,

(b) the value of the construction works = 33 600 125.52 RON excluding VAT, of which:

- value of expenses for arrangements for environmental protection and bringing the land to the initial state: 21 256.80 RON,

- value of expenses for ensuring the utilities necessary for the investment objective: 1047 501.00 RON,

- value of construction and installation works: 29 363 318.64 RON,

- value of machinery, technological and functional equipment that does not require installation and transport equipment: 2 966 506.36 RON,

- organizational value of site: 201 542, 72 RON (line 5.1.1. "Construction works site organization" from the work quotation).

The bidder, the third party supporters or the subcontractors are not intr-one of the situations provided in art. 164, 165, 167 of Law no. 98/2016 regarding public procurement. Method of fulfillment: the DUAE will be completed by the bidder and separately from the subcontractors / third party supporter. At the request of the contracting authority, only the tenderer ranked on the first place in the ranking prepared following the application of the award criterion, will present the documents juevidence proving the fulfillment of those assumed by completing the DUAE:

1) Romanian legal persons:

(a) the criminal record of the economic operator and of the members of the administration, management or supervisory body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate emoved by the ONRC / the constitutive document,

(b) the certificate of fiscal attestation from which the lack of the outstanding debts, regarding the payment of the contributions to the general consolidated budget, at the time of presenting them,

(c) the certificate of fiscal attestation from which it will come out lack of outstanding debts, regarding the payment of taxes and taxes to the local budget, at the time of presentation. They will presents the certificates of fiscal attestation regarding the fulfillment of the obligations of payment of taxes, taxes and social insurance contributions at all the premises and work points for which there are payment obligations,

(d) as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2) and art. 171 ofn Law 98/2016 on public procurement,

(e) other documents, as the case may be;

2) Foreign legal entities may present a declaration on their own responsibility or, if in the respective country there are no legal provisions regarding the declaration on their own responsibility, an authentic statement given in front of a notary, an administrative or judicial authority or a professional associationwhich has competence in this regard for the situations described in art. 164, 165 and 167 of Law no. 98/2016 regarding public procurement. Note: the requirement must also be met by associates, third party supporters and subcontractors in the situation where they exist. In order to complete the DUAE.

Requirement no. 2. The bidder must not comply with the situations provided in art. 59 and art. 60 paragraph (1)of Law no. 98/2016 regarding public procurement (avoiding conflict of interests). Method of fulfillment: the DUAE will be completed by the bidder and separately from the subcontractors / third party supporters. At the request of the contracting authority, the bidder will be presented on the first place after applying the award criterion:

1) Form no. 1 statement regarding the non-classification in situthe atias provided for in art. 59 and art. 60 paragraph (1) of Law no. 98/2016 regarding public procurement (avoiding conflict of interests). For this declaration, the persons holding decision-making functions within the authority regarding the organization, the development and the completion of the award procedure within the meaning of the mentioned article are the following:

- Vasile Adrian Silasi mayor,

- AndreiPapp deputy mayor,

- Ovidiu Muresan secretary,

- Mitroi Florin provider of auxiliary public procurement services from Leader Architects & Engineers SRL

Information and formalities necessary for evaluating compliance with the mentioned requirements: the bidder must be legally constituted, not in any situation to cancel the constitution, to have the right to carry out the activity afthe issue of the object of the contract, and its activity is authorized by the competent authorities on the basis of art. 15 of Law no. 359/2004. Method of fulfillment: the DUAE will be completed by the bidder and separately from the subcontractors / third party supporter. In the case of the offerr placed on the first place, with prices are equal, requests will be submitted for the submission of new price offers, until a single offer will be split. Attention:

1) Requests for clarifications will be completed exclusively in SEAP at the "Questions" section, and the answers to these will be published in SEAP, too.economic hours must be registered in SEAP (www.elicitatie.ro) as an economic operator and as a participant in the award procedure. The evaluation commission will send the clarification requests in relation to the offer submitted in SEAP, under the "Questions" section.electronic signature, according to the provisions of Law no. 455/2001 regarding the electronic signature;

2) The answers to the clarifications will be published exclusively on SEAP (www.e-licitatie.ro). The risks of not accessing the clarifications fall to the economic operator.

Details:

The winning bid will be established only after applying the award criterion "the lowest price" to the declared offers admissiblethem. In the case of the bidders whose offer was not declared a winner in the communication regarding the result of the procedure, it will be specified if the offer was rejected and what are the reasons for the rejection, and if it was admitted but not winning, the name of the successful bidder will be indicated, as well as the characteristics and relative advantages of the winning offer compared to the respective offerbidder declared non-binding. In the case of the winning bidder in the communication, it will be specified that his bid has been declared a winner and that he is invited to conclude the works contract. The contract enters into force after its signature by both parties and the establishment of the guarantee of good execution.
