The subject of the open procedure is the selection of a contractor with the subject "Execution of an engineereng (design, supervision and construction) of sites under separate positions for major repair and change of purpose of two sites in connection with the establishment of a functioning Center for Support of Persons with Disabilities, including Severe Multiple Disabilities in Varna Municipality "

1. Preparation of an investment project in the phase of a technical project according to the scope and scope, regulated in the Spatial Planning Act, Ordinance No. 4 of May 21, 2001 on the scope and content of the investment projects, the relevant legislation, as well as those laid down in the Technical Specificationidentification of requirements for the development of the investment project.

2. Execution of construction works according to technical / work design, prescriptions and orders in the order book, incl. projected with the quantitative account construction works.

3. Supply and investment in the construction of the construction products needed and corresponding to the investment project.

4. Production and / or delivery of construction parts / elementsments and equipment and their incorporation into construction.

5. Notifying the contracting authority of the need for additional design.

6. Performing necessary tests and laboratory tests.

7. Drawing up construction papers and preparation of executive construction documentation.

8. Participation in the procedure for putting the building into operation.

9. Remedy of deficiencies identified inand the commissioning of the construction and its commissioning.

10. Remedy of defects during the warranty period, determined by the contract in accordance with the offer.

11. Author`s supervision.

The participant must have registration in the Central Professional Register of the builder: first group, construction of the fourth category according to the requirements of HCC and TSA, if the participant in the procedure is foreign FL or UL should have registration in similar registers according to the legislation of the Member State in which they are established or of another country party to the Agreement on the European Economic Area.

* Reasons: This requirement is imposed by the type of work to be performed: In view of this, a potentialAll construction contractors have to be registered with the CSB for the execution of construction works of the respective category according to Ordinance No. 1 on the nomenclature of types of construction works. The absence of such a document by the builder will make the contractor unable to fulfill his obligations under Art. 157, para. 2 of the TSA - sentence 2.

The participant completes (declares) in part IV, letter "A", point 1 of the single European eProcurement Document (EDES) these requirements.

In the cases of Art. 67, para. 5 of the Public Procurement Act shall be submitted: a copy of the Certificate for entry in the CPRS to the Construction Chamber - first group, construction of the fourth category. 1. The assignor shall remove from the procedure a participant for whom the grounds under Art. 54, para. 1 and Art. 55, para. 1, item 1 of the PPA, which occurred before or during the procedure, as well as in the cases of a participant in the procedure, which is a merger, and there are somethe defenses of art. 54, para. 1 and Art. 55, para. 1, item 1 of the Public Procurement Act for natural and / or legal persons - member of the association. Information on the absence or existence of grounds for removal shall be declared in the EDES Part III.

2. Specific national grounds for exclusion to be declared in Part III of the EDES:

1. The participant should declare the absence or presence of a memberla conviction for a crime under Art. 194-208, Art. 213a-217, Art. 219-252, Art. 254a-255a or Art. 256-260 of the CC.

2. The participant should not be a related party with other participants in the present procedure according to Art. 101, para. 11 PPA

3. The participant should not be found with a punitive decree or court decision, violation of Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 andor 2, Art. 228, para. 3 of the Labor Code or similar obligations established by an act of a competent authority under the law of the country in which the participant is established.

4. No violation of Art. 13, para. 1 of the Labor Migration and Labor Mobility Act.

5. The circumstances under Art. 69 of the Counteraction Actcorruption and forfeiture of illegally acquired property.

6. The participant shall meet the requirements of Art. 3, item 8 and art. 4 of the Law on Economic and Financial Relations with Companies Registered in Preferential Tax Jurisdictions, Controlled Persons and Their Real Owners by a Participant / Subcontractor

2. Guarantees for the implementation of this volSubstantive procurement shall be submitted in one of the forms in accordance with Art. 111, para. 5 of the PPL. Pursuant to Art. 111, para. 2 of the Public Procurement Act, the contracting authority defines a contract performance guarantee of 3% of the contract value to be paid by the successful participant to the client`s account or to provide a bank guarantee, or to provide insurance, which guarantees the performance through the contract.discovery of the contractor`s liability before the contract is signed. The submission of the performance guarantee in the form of a monetary amount shall be made with a payment order under IBAN: BG 63CECB97903324129200, BIC: CECBBGSF of the Municipal Enterprise "Investment Policy" - Varna Municipality in "Central Cooperative Bank" AD - Varna. The performance guarantee shall be released accordinglywith the terms of the draft contract.

5. The contract also provides for a guarantee that guarantees the full amount of the advance payment, in the form of a payment order to the bank account / bank guarantee / insurance (free form) mentioned above for the advance payment, which is 20% of the construction and construction fee (amount with VAT) under the contract. This guarantee shall be released within 3 days after the return or after alladvance payment and is valid as the proposed time limit for the execution of the subject of the contract.
