U.M. 02384 Bucharest intends to conclude a framework agreement for supply, with a maximum of 2 economic operators, for aluminum joinery (specifications and configuration according to the specification)

Estimated value of the largestSubsequent contract to be awarded during the framework agreement: RON 259, 000.00 without VAT. - Requirement 1: Statement of non-compliance with the provisions of art. 164 of Law no. 98/2016 on public procurement. The economic operator (leader, associate, third party) and subcontractor will present the DUAE form in the original documentation. Incorporating the situation-art. 164 of Law no. 98/2016 regarding the public acquisitions attracts exclusion of the applicant from the procedure applied for awarding the public acquisition contract.

Requirement 2: Statement regarding non-compliance with the provisions of art. 165 of Law no. 98/2016 on public procurement corroborated with art. 166 (2) of the same normative act.

Economic operator (leader, associate, third party) and subcontthe lecturer will present the DUAE form in the awarding documentation, in its original form. The framing of the situation stipulated in art. 165 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the tenderer from the procedure applied for awarding the public procurement contract. - Requirement 3: Statement regarding non-compliance with the provisions of art. 167 of Law no. 98/2016 on public procurement. The economic operator (leader, associate, third party) and subcontractor will present the DUAE form in the original documentation. The framing of the situation stipulated in art. 167 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the tenderer from the procedure applied for awarding the public procurement contract.

Requirement 4. Statement regarding non-compliance in the prevArt. 58 63 of Law 98/2016 on public procurement - Form 6.

Declaration according to art. 60 of Law 98/2016 will be submitted by the bidders, third parties and subcontractors with the DUAE.

The supporting documents proving the fulfillment of the assumed by the DUAE are to be presented at the request of the contracting authority only by the bidders placed on the first two places in the intermediate rankings prepared to complete bid evaluation. These documents can be:

1) Certifica(2) The judicial record of the economic operator and of the members of the administrative body, as well as of the members of the administrative body, who are responsible for the payment of taxes, management or oversight of that economic operator, or those having the power of representation, -decision or control within it, as evidenced by the certificate issued by ONRC / constitutive documents; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016.

Capacity to exercise professional activity in Conformity with art. 173 of Law 98/2016 on Public Procurement. The economic operators submitting the tender must prove a form of registration under the law of the country of residence, that they are legally constituted, that they are not in any of the situations of cancellation of the establishment and that they have the professional capacity to achieve the activities covered by the account• The manner of accomplishment: • The completion of the DUAE, on the basis of which the supporting document, respectively the Certificate issued by the Trade Registry Office or the foreign tenderers, equivalent document issued in the country of residence, is presented only at the request of the contracting authority, only by the tenderers on the first 2 places in the intermediate rankings finishedThe bidder will prepare the tender in accordance with the provisions of the awarding documentation and will indicate in its contents which information from the technical proposal and / or from the proposal financial statements are confidential, classified, or protected by an intellectual property right.

The offer is bindingin terms of content, for the entire period of validity set by the contracting authority and assumed by the bidder. The evaluation commission has the obligation to establish the winning bid of all the admissible tenders, based on the application of the award criterion. Prior to awarding the contract, the contracting authority shall ask the tenderer for dutyfirst place after application of the award criterion to submit, without delay, up-to-date supporting documents demonstrating the fulfillment of all

Qualification criteria, according to the information contained in the DUAE. Information on the person empowered to represent the economic operator for the purpose of participating in this procedure will be included in the DUAEpublic procurement. If, following the establishment of the final ranking according to the award criteria, the evaluation committee finds that there are two or more bids with the same value, the authority-the contracting entity will request clarification through the SICAP for electronic loading by economic operators and documents containing new values. In the re-fermentation process through SICAP, bidders have an obligation to improve or maintain the initial offer submitted to the SICAP. In case the bidders do not submit the new offers in accordance withthe contracting authority's requests or the submitted offers are no more advantageous than the initial ones or at least at their level, the contracting authority will reject the respective offers as non-compliant. Any communication, request, information, notification, and the like will be uploaded to the SICAP and signed with an extended electronic signature based on a qualified certificate, -issued by a certification service provider accredited under the law
