Tenderers, third parties and subcontractors, as the case may be, should not find themselves in the situations provided for in art. 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with information related to their situation. documentsjustifications proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidder placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the bids. These documents may be:

1) certificate of lack of overdue debts, regarding the payment of taxes, fees or contributions to the bug(2) the criminal record of the economic operator / social service provider and of the members of the administrative, management or supervisory body of that economic operator / service provider social or those who have the power of representation, decision or account(3) as the case may be, documents demonstrating that the economic operator / social service provider may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016.

With the submission of the DUAE, for each batch for-the tenderers will submit the commitment of the third party, the association agreement and the subcontracting agreement, if any, and the supporting documents for them will be submitted, at the request of the evaluation committee, only by the bidder ranked first. Tenderers, third parties and subcontractors, as the case may be, should not be found in the sitethe provisions of art. 60 of Law no. 98/2016, thus completing Form no. 6, statement to be presented, for each lot separately, with the DUAE, by the bidder, associate, subcontractor and supporter, as the case may be.

In the case of tenders not accompanied by the participation guarantee, the amount, the form and the period of validity requested in the Awarding Documentation, the evaluation committee will clarify with the tenderers within 3 working days from the deadline for submission of tenders under the sanction of rejection offer as unacceptable.
