2) Mowing times:

Ordering should be made as requiredThese are specified in the terms of the contract and the quality standards of work, in a way that guarantees the right quality.

The scope of services includes mowing grass, weeds, self-seeding along the entire width of the road strip, and removing regrowth of trees and shrubs along with their removal. The location and approximate width of the basket are specified in the bill of quantities constituting the attachment to the ToR.

1. From the awarding procedurethe Purchaser will exclude the contractor referred to in art. 24 paragraph 1 point 12) -23) of the PZP Act and the contractor with respect to which at least one of the following conditions apply:

1) with respect to which liquidation has been opened, in the arrangement approved by the court in the restructuring proceedings it is envisaged to satisfy creditors by liquidating its assets or the court ordered liquidationhis property under art. 332 paragraph 1 of the Act of 15 May 2015 - Restructuring Law (Journal of Laws of 2017, item 1508 and of 2018, item 149, 398, 1544 and 1629) or whose bankruptcy was announced, with the exception of the contractor who the declaration of bankruptcy has concluded an arrangement approved by a final court decision, if the arrangement does not provide for satisfaction of creditors by liquidation of the assets of the bankrupt, unless the court ordered the liquidation of his property pursuant to art. 366 section 1 of the Act of February 28, 2003 - Bankruptcy Law (Journal of Laws of 2017, item 2344 and 2491 and of 2018, items 398, 685, 1544 and 1629);

2) who is seriously committed he has violated his professional duties, which undermines his integrity, in particular if the contractor, as a result of the intended act or gross negligence, has not performedb he performed the contract improperly, which the contracting authority is able to demonstrate by appropriate means of evidence;

3) which, for reasons attributable to him, did not perform or improperly performed significantly the previous public procurement contract or concession contract concluded with the contracting authority referred to in art. 3 clause 1 point 1-4 of the PZP Act, which led to the termination of the contractor award damages;

2. In the case of invoking technical or professional abilities of other entities, it is required to demonstrate the lack of grounds for exclusion due to non-compliance by these entities with the conditions referred to in art. 24 paragraph 1 point 13-22 of the PZP Act and the reasons indicated in point VI 1.1) -3) SIWZ.

LIST OF STATEMENTS OR DOCUMENTS CONFIRMING FULFILLMENT OF CONDITIONS FOR PARTICIPATIONIN PROCEEDINGS AND NO EXCLUSION GROUNDS

1. The Contractor shall attach to the offer a current statement as at the date of submitting the offers in the form of a Single European Procurement Document, hereinafter EAT, which is an attachment to the extent indicated by the Employer in this ToR. The information contained in the statement constitutes preliminary confirmation that the Contractor: is not subject to exclusion and meets the conditionsparticipation in the proceedings.

Attention!

The Contractor in Part IV EAT "Eligibility criteria" may be limited to completing section α only, the Employer does not require any of the other sections of part IV.

2. Contractor who refers to the resources of other entities, in order to demonstrate that there are no grounds for exclusion or compliance with them, insofar as their resources are referred to, conditions for participation in the proceedings also submits uniform documents (EAT) regarding these entities

3. In the case of joint application by the Contractors, JEDZ shall be submitted by each of the Contractors jointly applying for the contract. These documents confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates compliance withparticipation in proceedings and no grounds for exclusion.

4. In addition, in addition to the Single European Contract Document, the Contractor is required to attach to the offer:

a) proof of payment of the bid security.

B) tender (including net price and VAT) along with the price form.

C) attachment to print the offer regarding solutions equivalent (in the case of offering equivalent solutions) (AnnexH).

D) an obligation or other documents of entities to provide the contractor with the necessary resources at the disposal of the contract if the Contractor relies on the capacities of other entities. The undertaking must be submitted in the original in the form of an electronic document (the document in electronic form signed by a qualified electronic signature).

E) in the case of joint applicationContractors for the award of the contract, the offer should be accompanied by a document establishing the representative to represent them in the contract award procedure or to represent them in the procedure and to conclude the public procurement contract in accordance with art. 23 clause 1 and 2 of the Public Procurement Law, if it does not result from the EAT included in the offer.

F) if the offer in ithe Contractor`s property is signed by a proxy, the offer should be accompanied by a power of attorney specifying its scope and signed by persons authorized to represent the contractor, if it does not result from the EAT included in the offer. defining its scope and signed by authorized personsof the Contractor.

5. The documents should be prepared in accordance with the templates attached to the ToR in the manner specified in point XI.

6. The power of attorney should be submitted in the form of an original in the form of an electronic document or a copy authenticated by a notary public in the case referred to in point 4 e), f), g).

7. The bid bond paid in a form other than money (Article 45 paragraph 6 points 2-5 of the Public Procurement Law Actzne) should be submitted in the form of an original in the form of an electronic document.

8. Employer, in accordance with art. 24 aa PZP Act will first evaluate the offers and then examine whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.

9. The contracting authority will call the contractor whose bid will be before awarding the contractthe highest rated, to be submitted within a specified period, not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances referred to in point 1) and 2) with the exception of lit. e) and documents referred to in item 2) with the exception of lit. e) in relation to entities whose capabilities the contractor relies on the principles set out in art. 22 a of the PPL Act.

1) In order to confirm that the contractor meets the conditions for participation in the proceedings regarding technical or professional capacity, the Contractor, at the request of the Employer, should submit in electronic form via the Public Procurement Platform the following statements and documents:

a. list of services referred to in point V.2.1) ToR, made not earlier than in the last three years beforethe deadline for submitting bids, and if the period of business is shorter in that period, together with the scope, date, place of performance and the entity for whom the services were performed, with evidence of whether these services were properly performed, the evidence in question are references or other documents issued by the entity for whichego services were performed, and if the contractor is unable to obtain these documents for other justified reasons,

b. list of tools, plant equipment or devices referred to in point V.2.2) ToR, necessary for the implementation of the public contract, together with information about the basis for the use of these resources;

2) To confirm the lack ofIf the contractor is excluded from participation in the procedure, the contracting authority will request the following documents:

a. information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the PZP Act, issued not earlier than 6 months before the deadline for submitting bids;
