The contracting authority intends to award the public procurement contract for: Water supply and sewerage services in Eselnita Commune, Mehedinti County.

1) The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure (including any third parties and subcontractors)

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted, at the request of the contracting authority, only by the bidder placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents may be:

- certificates found on the absence of overdue debts c• the criminal record of the economic operator and the members of the management, management or supervisory body of the respective operator economic or those who have power of representation, decision or control within it, som results from the certifying certificate issued by the ONRC / constitutive document,

- as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as appropriate; 2) Bidders, third parties and subcontractors will submit a declarationnon-compliance in the provisions of art. 60 of Law 98/2016. The statement will be submitted with the DUAE by all participants in the award procedure (bidder, associate, subcontractor and third party). The names of the persons holding decision-making positions within the contracting authority, those with powers of representation from the ancillary service provider as well as thosein the procedure of the latter:

The economic operators submitting the tender must prove a registration form according to the law of the country of residence, to make it clear that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution and thatthat he has the professional capacity to carry out the activities covered by the contract. The way by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively certifieda statement issued by the ONRC or, in the case of foreign tenderers, equivalent documents issued in the country of residence are to be submitted, at the request of the contracting authority, only by the tenderer ranked in the first place in the intermediate rankings drawn up at the completion of the tender evaluation.

Interaction with tenderers, respectively the bid evaluation process will be carried out as followsguli: To view the attribution documentation uploaded in SEAP, economic operators must have a program to view the electronically signed files (e-signature providers' websites). Rules for communication and data transmission: Requests for clarification regarding this awarding documentation will be addressed exclusively in SEAP in the section"Questions" in the award procedure conducted by electronic means, and the answers to them will be published in the SEAP in the "Documentation, clarifications and decisions" section of the simplified participation notice. In order to submit requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP (www.elicitatie.ro) as operatoraccording to the provisions of art. 5 par. (1) of H.G. no. 395/2016 the requests will be transmitted taking into account the contracting authorities' terms of reference provided for in art. 103 par. (2) of GD no. 395/2016. For subsequent posting submissions: the evaluation committee will forward the clarification requests in relation to the offer by using the available technical facilitiesthe evaluation committee will analyze the DUAE in correlation with the requirements set out in the acquisition data sheet.

The evaluation commission will analyze and check each tender in terms of the proposed technical elements, and then from of the financial aspects involved. Following the finalization of each of the verification phasesabove, the contracting authority will insert in the SEAP the admitted / rejected result and will open in the SEAP the session for the submission of the supporting documents related to the DUAE submitted by the bidder on the first place in the interim ranking made at the completion of the evaluation of the bids, granting a deadline. Economic operators will provide answers to clarifications and any required documents-during the evaluation of the offers through SEAP (the "Questions" section), in electronic format, signed with the electronic signature, according to the Law 455/2001.Economic operators will observe the contract model of the works Note: The way of ranking the first ranked tenders with equal prices:

- The classification will be made exclusively according to the price and not by the quantification of otherstechnical reasons or other advantages resulting from the way the contract is performed by the economic operators,

- In order to divide the tenders, the contracting authority will request the submission of new financial offers in SEAP (the procedure being carried out entirely by electronic means)
