The contracting authority intends to award the public procurement contract for: water supply and sewerage services in Eselnita Commune, Mehedinti County.

1) The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure (including any third parties and subcontractors)

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, only by the tenderer placed on the 1st place in the intermediate rankings drawn up at the completion of the evaluation of the tenders. be:

- founding certificates regarding the lack of overdue debts, -with regard to the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of submission, - the criminal record of the economic operator and the members of the management, management or supervisory body of the respective operator economic or those who have the power of representation, decision or control within it, so-as evidenced by the certifying certificate issued by the ONRC / constitutive document,

- as the case may be, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as the case may be; 2) Bidders, supporting third parties and subcontractors will presentthe declaration of non-compliance in the provisions of art. 60 of Law 98/2016. The statement will be submitted with the DUAE by all participants in the award procedure (bidder, associate, subcontractor and third party). The names of the persons holding decision-making positions within the contracting authority, those with the power of representation from the ancillary service provider, as well as those-involved in the procedure of the latter:

- Ciuru Ioan - mayor,

- Vasca Marius Emilian - deputy mayor,

- Bostina Ana - accountant.

The economic operators submitting the tender must prove a form of registration under the law of the country resident, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that it has the professional capacity to perform the activities covered by the contract. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with information related to their situation. Rules for communication and data transmission: Requests for clarification regarding this tender documentation will be addressed exclusively in SEAP, the "Questions" section of the award procedure by electronic means, and the responses to them will be published in the SEAP, in the "Documentation, clarifications and decisions" section of the simplified participation notice. In order to submit requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP (www.elicitatie.ro) aseconomic operator, according to the provisions of art. 5 par. (1) of H.G. no. 395/2016; the requests will be transmitted having regard to the contracting authority's deadlines provided for in art. 103 par. (2) of H.G. no. 395/2016. For subsequent posting submissions: the evaluation committee will forward the clarification requests in relation to the offer by using the technical facilitiesThe assessment commission will analyze the DUAE in correlation with the requirements established by the acquisition data sheet The evaluation commission will analyze and check each offer in terms of the proposed technical elements and then from with regard to the financial aspects involved. Following the completion of each of the verification phasesthe contracting authority will insert in the SEAP the admitted / rejected result and will open in SEAP the session for the submission of supporting documents related to the DUAE, submitted by the tenderer on the first place in the interim ranking made at the completion of the evaluation of the bids, granting a deadline for replying. Economic operators will forward the answers to clarifications and possible documen- tationrequired by the SEAP (the "Questions" section), in electronic format, signed with the electronic signature, according to Law 455/2001.
