The subject of the order is the modernization of the installation sorting municipal waste mixed and picked selectively The order will be implemented by the Contractor in form"Design and build" beehives.

1. The subject of the order is the modernization of municipal sorting installations mixed and separately collected. The order will be implemented by the Contractor in the "Design and Build" formula, as part of the following parts:

1) In the first columnThe Contractor will prepare and present to the Ordering Party for its acceptance, a detailed material and financial schedule, a construction design, a technological project for the first stage, referred to in PFU, a technological project for the second and final stage, referred to in PFU "Design Part". 2) Delivery and assembly of optopneumatic separators.

3) Construction and assembly part includes inthe repair and modernization of the installation in the existing hall, in particular the dismantling of the NIR 4 optopneumatic separator, modernization of the backfill and discharge of the ballistic separator intended for the separation of the plastics separated by the optical separator of the so-called 2D fraction (flat-light) and 3D fraction (spatial-heavier), assembly of complete technological equipment, change ofdesign solutions limiting the availability of sorting installations, ("Construction and Assembly Part").

4) Performing operational tests, the aim of which is to check the full compliance of all installation parameters with the requirements of the Employer (to meet the performance and quality requirements of built-in equipment) specified in the SIWZ ("Probna Movement"). Ruch Prwill be carried out no later than to the one indicated in - 6 para. 1 point 4) Contracts. The scope of activities within the Probation Movement is specified in SIWZ.

2. Joining the implementation of the Construction and Assembly Part depends on the prior completion of the Project Part by the Contracting Authority, and the accession to the Probation Movement is subject to prior accomplishment by Zfor the reception of the Construction and Assembly Parts. Description of the Modernization of the Installation, including the technical parameters of the Installation, requirements regarding the efficiency and quality of the Installation and the method of assembly of the elements constituting the Installation in the Plant, includes PFU. Technological project for the first stage, referred to in PFU and technological project for the second and final stage, referred to in PFU, may be drawn up in the form of a single document. - Proper execution by the Contractor of the contract is to enable the Employer permanent, full, undamaged, independent and legal use of the Plant in the Plant for the needs of the Plant, in a manner cohesive and compatible with other devices and installations used for the purposes of The plant, including the non-fatal-at any moment of their correct operation.

A detailed description of the subject of the order is presented in the Functional Program constituting Volume III of the Terms of Reference - 3. The details of the contract are set out in Volume II of the Terms of Reference Model Contract.

4. Information on the requirements referred to in art. 29 para. 3a:

4.1. The Employer requires employment based on a contract of employment by the contractor or the employerthe seller of all persons performing all construction and assembly works being the subject of this order / future contract in the course of the order's implementation.

The above requirement does not apply to persons in respect of whom the Contractor can demonstrate that the above-mentioned the activities will not be carried out under any direction and at the place and time appointed by the Contractor or Subcontractor and, as a rule, notand he applies to the Robot Manager. This requirement does not apply to self-employed persons and co-workers who work on the subject of this contract themselves.

b) meets the conditions for participation in the proceedings.

On request, they orderThe Contractor is obliged to submit the following declarations or documents:

1) In order to confirm compliance by the Contractor with participation conditions in the economic and financial situation:

- information of the bank or cooperative savings and credit union confirming the amount of funds held or creditworthiness of the contractor, in the period no soonerthan one month before the deadline for submission of tenders.

If for justified reasons, the Contractor can not submit a document regarding the financial or economic situation required by the Employer, he may submit another document, which sufficiently confirms fulfillment of the condition of participation in the procedure described by the Contracting Authority. . The Contractor is obliged to provide the Employer-valid as of the day of submitting bids a statement in the form of a Single European order document, constituting preliminary confirmation that the Contractor:

a) is not subject to exclusion,

b) meets the conditions for participation in the procedure.

2. The statement referred to in point 1. The Contractor is obliged to submit in accordance with the provisions of point 12.4 12.5 SIWZ Volume I in the form of EAT, which should be sent in the form of an electronwith a qualified electronic signature. Declarations of entities submitting the offer / application jointly and entities making the potential submitted on the EAT form should be in the form of an electronic document, signed with a qualified electronic signature by each of them in the scope in which they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law.

3. The offer is a completed "Offer" form. The offer should be submitted:

1) Statement required by the provisions of point 9.1 of the IDW;

2) Obligations required by the provisions of point 10.2 of the IDW, if the Contractor relies on the ability of other entities to confirm compliance with the conditions participation in the proceedings.

3) Contractor's statement regarding the RODO (form 3.3).

4) Power of attorney torepresenting all Contractors jointly applying for the award of a contract, possibly a co-operation agreement, which will result from this power of attorney. A proxy may be appointed to represent the Contractors in the proceedings or to represent in the procedure and conclude the contract. The power of attorney should be attached in the form of the original or notarized copii;

5) Documents from which the right to sign the offer (original or a copy certified for compliance with the original by a notary public), or to sign other declarations or documents submitted together with the offer, unless the Purchaser can obtain them in detail, free of charge and publicly available databases, in particular public registers within the meaning of the Act of 17.2.2005 on the computerization of entities operating public tasks (ie, Journal of Laws of 2017, item 570, as amended), and the Contractor indicated this along with the submission of the offer, unless the right to sign them does not result from the documents submitted together with the offer;

6) The original of the guarantee or surety, if the deposit is paid in a form other than money.

4. In order to confirm the absence of grounds for exclusion of the Contractorfrom participation in the proceedings, the Contractor, within 3 days from the date of posting on the website the information referred to in art. 86 par. 5, provides the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of Public Procurement Law

5. The Contracting Authority anticipates the orders referred to in art. 67 sec. 1 point 6 of the Public Procurement Law, ie it provides-the possibility to grant, within 3 years from the date of ordering the basic, previous contractor, the ordering robot relying on the return of similar construction works, for which the value will not exceed 20% of the value of the basic order.

6. The Awarding Entity may, at any stage of the proceedings, consider that the Contractor does not have the required capacities if the involvement of technical resourcesor professional Contractor in other Economic Operations of the Contractor may have a negative impact on the implementation of the order.

7. Contractor can in order to monster. meeting the conditions of participation in the procedure, in appropriate situations and with regard to a specific order, or a part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, irrespective of the legal nature of the legal relationship that it has with it. In such a case, he must prove to the Ordering Party that while performing the order, he will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary resources for the needs of the order.
