Management waste with the code 19 08 05 originating from the "South" and "Dębe" plant divided into tasks:

Main Site: Warsaw

Waste management with the code 19 08 05, originating from the"South", in a maximum amount of 12, 040 Mg.

1. Contractors who:

1.1 meet the conditions for participation in the procedure regarding the possession of competences or rights to conduct specific professional activities may apply for the order, provided that this obligation results from separate provisions, i.e.: in the scope of tasks from 1 to 5:

a) have a current entry in the register referred to in Article 49 of the Actof 14.12.2012 on waste (Journal of Laws of 2019, item 701) hereinafter referred to as the "Waste Act" in the field of transport of waste with codes 19 08 05;

b) have a current decision permitting processing by recovery waste with codes 19 08 05 issued on the basis of the Waste Act, valid for the entire duration of the contract.

Note! The contractor is obliged to follow the procedure described in - 3paragraph. 9 of the draft contract for task No. 1-5, which says: "The Contractor is obliged to provide the Employer by 5.3.2020 at the latest with a copy of the confirmation of acceptance by the authority of the request to amend the decision in accordance with art. 14 paragraph 1 of the Act of 20.7.2018 on the amendment to the Waste Act and some other acts "

1.2 are not subject to exclusion under Article 24 paragraph 1 points 12-23 of the Act onpublic speaking hereinafter referred to as the "Act" or "Public Procurement Law" (from the provision of Article 133 (4) of the Public Procurement Law) and pursuant to Art. 24 paragraph 5 points 1, 4-8 Pzp

2. Assessment of compliance with the conditions for participation in the procedure (according to the formula "meets / does not meet") and the absence of grounds for exclusion will be made on the basis of:

a) the Contractor`s initial statement contained in the Single European Order Document "EAT" - in relation toany Contractors who submitted bids, and

b) documents and statements confirming the fulfillment of the conditions for participation in the procedure and the absence of grounds for exclusion regarding the Contractor whose bid is the highest rated.

3. The Employer requests submission of:

3.1a) At the stage of submitting bids from all Contractors:

a) uniform / these European / their document / s in the order - in accordance with item 6.1a) IDW, constituting part I of the ToR;

b) Other statements and documents, which are indicated in the ToR, that they should be attached to the offer.

3.1 b) The Awarding Entity, before awarding the contract, will call the Contractor whose offer will be assessed as the most advantageous, to be submitted within a specified period, not shorter than 10 days, valid on the day of submitting statements or documents confirmingthe circumstances referred to in art. 25 paragraph 1 Public Procurement Law, i.e. documents referred to in items 6.1b) and 6.1d) IDW

3.1 c) Each Contractor, in accordance with art. 24 paragraph 11 Public Procurement Law, is obliged to submit within 3 days from the date of posting on the Employer`s website information referred to in art. 86 section 5 Public Procurement Law, i.e. the document referred to in item 6.1.c) IDW.

3.1 d) Contractor having its registered office in the territory of the Republic of Poland, in relation to persons residing outside the territory of the Republic of Poland, to whom the document referred to in item 6.1b) (a) IDW applies, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm compliance with the condition referred to in point 1 point 1.1, the Contractor whose tender will be assessed as the most advantageous will present:

In the scope of tasks from 1 to 5:

a) current entryto the register referred to in art. 49 of the Waste Act in the field of waste transport with codes 19 01 14 and 19 03 07,

b) the current decision authorizing processing by recovery of waste with codes 19 01 14 and 19 03 07, issued on the basis of the Waste Act, valid for the entire period of the contract.

Note! The contractor is obliged to follow the procedure described in - 3 para. 10 draft contract, which says: "The Contractor is obliged to provide the Employer by 5.3.2020 at the latest with a copy of the confirmation of acceptance by the authority of the request to amend the decision in accordance with art. 14 paragraph 1 of the Act of 20.7.2018 amending the Act on waste and some other acts. "

5. The Employer will assess (if applicable) whether technical or professional capacity made available to the Contractor by other entities orfinancial or economic situation, allow the Contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether there are grounds for exclusion, referred to in art. 24 paragraph 1 point 13 22 of the Act (subject to Article 133 (4) of the Act) and Article 24 paragraph 5 points 1, 4-8 of the Act. The awarding entity will request the submission of relevant entities for these entitiesdocuments referred to in item 6.1.b) IDW

1. If, for a justified reason, the Contractor cannot submit the documents required by the Employer in point III.1.3 item 2 of the announcement, the Employer allows the submission by the Contractor of other relevant documents to confirm compliance with the conditions for participation in the procedure specified in point III 1.3 point 1.1 of the announcement.

2. Refers to point III.1, respectively.3): The Contractor may rely on the technical or professional ability or financial or economic standing of other entities to confirm that the conditions for participation in the procedure, in appropriate situations and in relation to the contract in question are met, regardless of the legal nature of the entities linking him to it. legal relations, on the principles set out in IDW (point 6.5 IDW, subject to the obligation to submit the documents indicated therein.

3. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, he shall submit a relevant document or documents in accordance with the principles set out in point 6.6. IDW.

4. Offer validity period: 60 days.

5. The awarding entity does not envisage the award of the contract referred to in art. 134 section 6 item 3 of the Act.

6. The offer should be madeand in Polish. Documents in a foreign language should be submitted together with a translation into Polish.

7. The offer along with the required documents should be prepared and submitted in accordance with the principles set out in the announcement, IDW and applicable law, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in proceedingsfor the award of the contract and Public Procurement Law

9. Required deadline for the contract:

The subject of the contract will be implemented successively, at each request of the Employer, from the date of the contract (but not earlier than from 1/1/2020) to 31/12/2021 or until the limit on sediments, depending on which of the above will happen firstthe one concerns task 1 5.
