Purchase of minimum 400 and maximum 1 800 eurocontainer pieces based on a framework agreement.

Bidders, third-party supporters and subcontractors must not be found in the situations provided for in art.. 164, art. 165 and art. 167 of Law no. 98 / 2016.

The manner in which the preliminary fulfillment of the requirement can be demonstrated: the bidders (including any associates / subcontractors / third-party supporters) will complete at DUAE level, the information related to their situation. The supporting documents are to be presented at the request of the contracting authority, only by the tenderer ranked on the firstplace in the intermediate ranking (including for any associates / subcontractors / third-party supporters), at the end of the evaluation of the offers or at any time during the awarding procedure, at the request of the contracting authority. regarding the payment of taxes, fees or contributions to budgetsgeneral consolidated table (local budget for all work points, state budget, etc.) at the time of presentation;

2) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or those who they have power of representation, decision or control within it, as it results from the certificate foundissued by ONRC;

3) as the case may be, documents proving that the economic operator can benefit from the derogations provided by art. 166 para. (2), art. 167 para. (2), art. 171 of the Law 98/2016 on public procurement;

4) other edifying documents, as the case may be.

Note: the offers submitted by economic operators appearing with outstanding debts not paid to the state budget or asre the local budget will be rejected except for those included in the situations provided by art. 166 para. (2) of Law 98/2016, with the amendments with the subsequent completions.

1) In order to meet the qualification requirements, the economic operators will complete the DUAIt is in SEAP, following the contracting authority to request the documents of qualification to the bidder ranked first after applying the award criteria or at any time during the period of the procedure, according to prev. art. 196 paragraph (1) of Law 98/2016. According to the ANAP Notification dated 8.4.2019, DUAE is filled directly in the SEAP, after authentication, by each participant. For the casecountries in which the tenderer is an association or in cases where the tenderer has subcontractors or third-party supporters, each economic operator shall authenticate in the system and access the award procedure for completing the DUAE in the quality in which it was included in the procedure (associate, subcontractor, third supporter);

2) It is necessary that all those who have to complete the DUAE must beregister as users in SEAP;

3) If 2 or more offers are ranked first, have equal prices, the contracting authority will request new financial proposals and the winning bid will be designated the one with the lowest financial proposal;

4) To open the files posted in SEAP with electronic signature, use the software SAFE Verify shell - Free utilitywith which the electronic signature can be verified and allows to view the electronically signed documents;

5) The presumption of legality and authenticity of the presented documents. The bidder assumes the exclusive responsibility for the legality and authenticity of all the documents presented in original and / or copy in order to participate in the procedure. Analyzing the documents presented by the biddersby the evaluation commission it undertakes no responsibility or obligation on its part to accept them as authentic or legal and does not remove the exclusive responsibility of the tenderer in this respect.
