Requirements regarding the grounds for exclusion:

Requirement no. 1:

The economic operator (individual bidder, member of an association, subcontractor, third party supporter) or any person who is a member of the board of directors / management, supervisory or supervisory bodies, or who have the power to represent, or accountrole within it is not in any of the situations mentioned in art. 164 par. (1) of the Law no. 98/2016, on grounds of exclusion regarding criminal convictions.

The contracting authority is entitled, according to the provisions of art. 166 par. (1) of the Law no. 98/2016, in exceptional circumstances, and for overriding reasons of general interest such as public health or protectioned, not to exclude an Economic Operator in the above situations. 2:

The economic operator (individual bidder, member of an association, subcontractor, third party supporter) is not in any of the situations mentioned in art. 165 par. (1) and par. (2) of the Law no. 98/2016, on the grounds for exclusion regarding the payment of taxes or contributions to aboutThe reasons for exclusion for the breach of obligations to pay taxes, taxes and contributions to the state budget (referred to in Article 165 (1) and (2) of Law No 98/2016) apply to operators for which this violation has been established by a final court decision or an administrative decision having a final and binding-in accordance with the law of the State in which the economic operator is established or for which the contracting authority can demonstrate by appropriate means the situation of violation of the obligations to pay taxes, duties or contributions to the general consolidated budget

The economic operator is not excluded from the procedure if has made the payment of these obligations or has waived his obligationsin other ways of extinguishing or benefiting from payment rescheduling or other facilities for extinguishing these obligations, under the conditions specified in art. 165 par. (3) of the Law no. 98/2016, before the contracting authority makes the exclusion decision.

The contracting authority is entitled, according to the provisions of art. 166 par. (2) of the Law no. 98/2016, to maintain an economic operator in-the award procedure, even if it is in the situations described in art. 165 par. (1) and (2) when the amount of these payment obligations is less than RON 10, 000 or when they are over RON 10, 000, but they represent less than 5% of the volume of these obligations at the last maturity. 3:

The economic operator (individual bidder, member of an association, subcontractor, supporter of terparty) is not in any of the situations mentioned in art. 167 par. (1) of the Law no. 98/2016, on the grounds of exclusion regarding insolvency proceedings, conflicts of interest or professional misconduct.

For verification of the information from the DUAE, the following documents are requested: - certificates showing the lack of debts on the payment of taxes, taxes or contributions to the general consolidated budget (local budget, bug(annual) for each of the last three financial years. The total annual turnover (annual) for each of the last 3 financial years ended. The tenderer (individual economic operator or any member of the association) has to prove a general turnover for each of the last 3 financial years, respectively 2015, 2016, 2017 of at least 1 155 000 RON.

The documentation will be downloaded from the website www.e-licitatie.ro. All answers to requests for clarifications requested by economic operators or formulated by the contracting authority / CNSC decisions / complaints / information notes / remedial measures will be posted on the website www.e-licitatie.ro under the heading Documentation / clarifications / decisions as well as by publication-to be eradicated. The framework agreement will be concluded with all the economic operators ranked on the places corresponding to the maximum number of mentioned economic operators, respectively. 3. In the case of the tenders in first place in the intermediate rankings, in order to divide them, the contracting authority will request a new financial proposal, and in the case of equal offers in the other placeswill require a new financial proposal that will not exceed the value of the bids placed on the previous place
