Veterinary care for bisons in the Lesko Forest District in 2019-2023

1. Przedm. Order a. is a service consisting in providing veterinary care for the European bison population living in the Lesko Forest District, whose number was estimated in 2019 at 128 individuals, particularly in terms of preventing and combating bovine tuberculosis.

1. The subject of the contract is a service consisting in providing veterinary care to the European bison population living in the Lesko Forest District, whose number was estimated in 2019 at 128 individuals, especially in terms of preventing and combating bovine tuberculosis.

2. Performing health and individual condition assessment by observationsbison in the woods, in the meadows, clustering around feeding places, at least twice a month.

3. Selection and purchase of antiparasitic drugs for the European bison at the Contractor`s expense with existing scientific indications and laying, e.g. in feeding places.

4. Performing at the expense of the Contractor parasitological exploratory tests, in particular collecting and testing bison feces for endoplasasożytow.

5. Contractor`s intervention readiness to appear at the place of finding a fallen / injured bison within a maximum of 3 hours. from a telephone notification made by the Employer.

6. Emergency treatment (including any necessary surgical procedures).

7. Counseling and nutrition control.

8. Collection of biological material for laboratory tests at indications, eachm in the case of immobilization.

9. Put selected bison to sleep if needed.

10. In vivo or posthumous collection from bison, samples of biological material for microbiological, genetic and other tests according to existing indications.

11. Participation in consultations, meetings and training on health and bison breeding organized by the Employer.

12. Preparation of periodic reportsports in a descriptive form, together with photographic documentation of the implementation of the task and handing them over to the Ordering Party within the following dates:

- until 20.12.2019 annual report for 2019 (covering the period from the conclusion of the contract to 20.12.2019),

- by 20/06/2020, the mid-year report in 2020,

- by 20/12/2020, the annual report for 2020,

- by 20/06/2021, half-year reportin 2021,

- until 20/12/2021, the annual report for 2021,

- until 20/06/2022, the mid-year report in 2022,

- until 20/12/2022, the annual report for 2022,

- until 20.3.2023, the report for the first quarter of 2023.

Each subsequent report will cover the work carried out in the period since the previous report was prepared.

13. The Employer requires employment by the Contractor, based onfor employment within the meaning of the provisions of the Act of 26.6.1974 - Labor Code (Journal of Laws of 2018, item 917, 1000, 1076, 1608 and 1629) of persons who will perform activities falling within the scope of the contract.

14. Pursuant to the content of art. 29 paragraph 3b Public Procurement Law. The Employer informs about the need to transfer property rights to reports that will arise as a result of the subject of the contract.

15. The proceedings are conducted in accordance with the rules provided for the so-called "Reverse procedure", referred to in Article 24aa (1) and (2) of the Public Procurement Law. in proceedings.

16. Employer for informationif the subject of this contract will be co-financed under the Operational Program Infrastructure and Environment 2014-2020.

17. The Awarding Entity does not provide for the possibility of awarding contracts referred to in art. 67 section 1 point 6 Public Procurement Law

18. The contracting authority does not allow the submission of variants, it does not provide for the conclusion of a framework contract, it does not provide for the selection of the bestmore favorable offer using the electronic auction. It does not require any security on due performance of the contract.

19. Communication between the Employer and the Contractor takes place using https://miniportal.uzp.gov.pl/, ePUAPu https://epuap.gov.pl/wps/portal and e-mail lesko@krosno.lasy.gov.pl . Contractors who are not subject to exclusion may participate in the proceedingsfrom the procurement procedure in the circumstances referred to in art. 24 paragraph 1 points 12-23 of the Public Procurement Law and art. 24 paragraph 5 points 1-2 and 4-8 of the PPL Act

2. Contractors who meet the conditions for participation in the proceedings referred to in art. 22 paragraph 1 of the Public Procurement Law Act concerning:

1) competences or authorizations to conduct specific professional activities, as far as it resultsfrom separate provisions.

This condition will be met if the Contractor demonstrates that he has an entry in the register of animal treatment establishments, kept by the appropriate district veterinary council, in accordance with the provisions of the Act of 18.12.2003 on animal treatment establishments (i.e. Journal of Laws of 2019, item 24).

3. The contractor may rely on technical or professional skillsor the experience of other entities, regardless of the legal nature of the relationships which it has with them. In such a situation, the Contractor must prove to the Employer that while implementing the contract, he will have the necessary resources of these entities, in particular, presenting the undertaking of these entities to make available to him the necessary resources for the purposes of the contract. The document from whichit will result from the obligation of a third party should clearly indicate the will to provide the Contractor with the order with the appropriate resource, i.e. indicate which resource is concerned, specify its type, scope, time of access and other circumstances resulting from the specificity of the given resource. The content of the presented document must clearly show:

1) the scope of accessother Contractor resources of another entity;

2) the method of using the resources of another entity by the contractor in the performance of the public contract;

3) the scope and duration of the participation of another entity in the performance of the public contract;

4) whether the entity on which the Contractor relies in relation to to the conditions for participation in proceedings relating to education, professional qualifications or experiencezenia, will perform the services to which the indicated capabilities relate.

4. If the Contractor, demonstrating compliance with the conditions referred to in art. 22 paragraph 1b of the PPL Act, consists of the resources of other entities on the principles set out in Art. 22a paragraph 1 of the Public Procurement Law, the Contractor will be obliged to:

1) submit a third party`s declaration of compliance with the conditions for participation in the proceedings (within the scope of theto which it provides its potential) and the lack of grounds for exclusion submitted on the EAT form. EAT of a third party should be submitted before the deadline for submission of bids, otherwise being null and void, in electronic form with a qualified electronic signature;

2) submission of the third party`s commitment or other document serving to demonstrate access to the Contractorpotential by a third party. Third party commitment or another document serving to demonstrate the availability of the potential to the Contractor by the entity should be submitted before the deadline for submission of tenders under pain of nullity, in electronic form, provided with a qualified electronic signature;

3) presentation of documents in electronic form with respect to these entities, bearing a qualified electronic signature as listed in point 6.1 (a) e-m SIWZ, Documents listed in point 6.1 lit. e-m SIWZ The Contractor shall be obliged to submit within the time limit specified by the Employer, not less than 10 days, specified in the call issued by the Employer to the Contractor after opening the offers.

The Employer does not impose specific requirements in the description of meeting thiscondition of participation in the procedure.

The Contractor shall submit with the offer:

a) the Contractor`s statement constituting a preliminary confirmation of the fulfillment of the conditions for participation in the procedure specified in this ToR and the absence of grounds for exclusion, submitted on the form of the Single European Order Document (hereinafter: "EAT"), whose template is specified in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016.establishing a standard single European order document (Official Journal of the EU series L 2016 No. 3, p. 16). The content of the JEDZ is specified in Annex 2 to the ToR, however, due to the need to provide a significant amount of information in the content of the JEDZ, the Employer recommends using the editable version of this document placed on the Employer`s website or at https://www.uzp.gov.pl/ base-knowsbetween / uniform-European-order-document.

EAT must be submitted together with the offer.

The Contractor shall submit the following documents at the request of the Employer within no less than 10 days:

b) list of persons referred by the Contractor to perform the contract;

c) list services rendered;

d) confirmation of having an entry in the register of animal treatment establishments kept by the appropriate district councilę medical and veterinary, in accordance with the provisions of the Act of 18.12.2003 on animal health care facilities (i.e. Journal of Laws of 2019, item 24); economic activity, if separate provisions require an entry in the register or a register in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the PPL Act;

f) lit. the competent head of the tax office confirming that the Contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting bids or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular he obtained predictionsexemption, deferral or installment of overdue payments by law, or suspension in full of the implementation of the decision of the competent authority;

g) of the relevant local organizational unit of ZUS or KRUS or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions issued not earlier than 3 months before the deadline for submissionbids or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these receivables, together with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments provided for by law or withholding in full the decision of the competent authority;

h ) information from the KRK to the extent specified in art. 24 paragraph1 point 13, 14 and 21 of the Public Procurement Law and regarding conviction for an offense against imprisonment, to the extent specified by the Employer pursuant to art. 24 paragraph 5 points 5 and 6 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submission of bids;

i) the Contractor`s statement that he has not issued a final court judgment or the final administrative decision on arrears of paymenttaxes, fees or social security or health insurance contributions, or in the event of such a judgment or decision being issued, documents confirming the payment of such receivables together with any interest or fines, or the conclusion of a binding agreement on the repayment of those receivables (in relation to the condition of exclusion described in art. 24 (1) (15) of the Public Procurement Law);

j) statementsnot to the Contractor about the lack of a judgment against him as a precautionary measure forbidding public procurement (in relation to the premise of exclusion described in Article 24 (1) (22) of the Public Procurement Law);

k) the Contractor`s statement on the lack of a final conviction for the offense to the penalty of restriction of liberty or a fine to the extent specified by the Order. based on Art. 24.57 P.zp ... Cd. in point VI.4.3)
