Reasons for exclusion: bidders, associations, third-party supporters, proposed subcontractors, as the case may be, nomust be found in the situations provided in art. 164, 165, 167 of Law no. 98 / 2016.

The method by which the requirement can be demonstrated: the DUAE will be completed by the participating economic operators, associations, third parties, subcontractors proposed, as the case may be, to the award procedure, with the information related to their situation.

In case of submission a common offer, DUAE will be completed by each economic operator.

Once the DUAE submission is submitted, the association agreement and / or subcontracting and / or the commitment of the third party supporter together with documents annexed to the commitment, transmitted to them by the third party / third party supporters, resulting from the effective way in which the support will be materialized (as the case may be).

The supporting documentsassets that prove the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the bidder ranked on the first place in the ranking prepared at the end of the evaluation of the bids:

1) certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (budgetlocal, state budget, etc.) at the time of their submission;

2) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power to represent, decide or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act;

3) as the case may be, the documententities that prove that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement. They will be presented in one of the following forms: original, certified copy, certified copy "according to the original";

4) any document considered edifying in the country of origin or in the country in which I offerthe agreement is established or other equivalent documents issued by the competent authorities of the respective country. In case there are uncertainties regarding the existence or non-existence of an exclusion situation, the contracting authority has the right to request information directly from the foreign competent authorities;the conflict of interest will be presented by both the bidders, associates, third parties and subcontractors (as the case may be) with the DUAE submission. decision functions within the contracting authority regarding the organization, development and finalizationThe procedure is:

1) The capacity to exercise the professional activity: the economic operator submitting the offer must prove a form of registration in accordance with the legal requirements of the country in which it is established, as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract.

The manner in whichthe fulfillment of the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. In case it is found that the offers ranked in the first place have equal pricesTo them, the contracting authority will request clarifications through SEAP, in order to electronically upload economic documents for documents containing new prices. The analysis of the documents presented by the bidders by the evaluation commission does not undertake any responsibility or obligation on its part to accept them as authentic or legal and does not remove the exclusive responsibilityof the tenderer in this respect. Alternative offers are not accepted. Bids that have been submitted to a different address than SEAP and those submitted without an extended electronic signature will be rejected. Documents issued in a foreign language must be accompanied by an authorized translation into Romanian. To view the attribution documentation uploaded in SEAP, the economic operators trit must have a program required to view the electronically signed files (this program is available free of charge on the websites of the electronic signature providers).
