Based on the contract, verification services will be provided of the projects, as required by the design theme and the conceptual note. The project verifier / verifiers aremake available all the technical designs developed by the designer for certification to the essential requirements as required by the Design theme and the conceptual note. The contracting authority will respond clearly and fully to all clarification requests / additional information 10 days before the deadline set for the submission of tenders, invitations to which requests will be addressed at least 15 days before the deadline set for submission of tenders. Clarifications submitted after this deadline will no longer be considered.

Main Site: At the headquarters of the provider, Str. 1 December 1918, at the headquarters of the contracting authority, as the case may be.

Based on the contract to be concluded, technical verification services will be providedof the project to the essential requirements, in accordance with Law 10/1995 and H.G. 925/1995, as set out in the Tender Book and the Conceptual Note. Verifier / project verifiers will be provided with all the technical designs developed by the designer for certification to the essential requirements as required by the Tender Specificationsand the conceptual note.

Timişoara will exclude at any time the award procedure, any economic operator who is in one of the situations provided by art. 60, 164, 165 and 167 of Law 98/2016 on public procurement. Exclusion reasons will also apply to supporters / subcontractors / third parties, as appropriate.

Way to perform:Under the sanction of rejection of the offer as unacceptable, each economic operator participating in the awarding procedure (tenderer, associated tenderer, subcontractor, third party supporter, as the case may be) will present with the offer and DUAE completed according to the provisions of art. 193 of Law 98/2016, with the information related to their situation.

Will be presented:

(a) Statement of non-compliancepotentially generating conflicts of interest, as defined in Art. 60 of Law no. 98/2016 - by all participants in the procedure,

(b) and, where appropriate, firm commitment of the third party, accompanied by documents showing the effective manner in which its support will materialize, the subcontracting agreement and / or Association. The supporting documents thatto prove the fulfillment of the assumed by completing the DUAE shall be submitted, only at the request of the contracting authority, by the bidder placed first after the application of the award criterion on the admissible tenders.

The supporting documents may be:

1) certificates regarding the lack of debts, to pay taxes, taxes, or contributions to the generic budget(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator or of those having the power to represent, decide or control within it, as evidenced by the certifying certificate issued by the ONRC / constitutive act; 3) as the case may be, it is demonstrated that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016; 4) other editorial documents, as the case may be.

Requests for clarification (if applicable) will be submitted within the deadline for addressing the requests specified in Section I - point 1.3 of this document, and those addressed outside this deadline will not be considered. Response to requests will be published in the SICAP in the tender notice; 5) If the contracting authority-requests clarification / completions for the purpose of verifying the compliance of the offer with the required requirements, both the request and the bidder's reply are transmitted in SICAP, only in electronic form, signed with the extended electronic signature. If the bidder's response is posted in the SICAP without the extended electronic signature, its offer will be assimilated to the provisions of art.. 137 par.
