1) Certificates regarding the lack of debts, regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation . From these certificates, there must be a lack of overdue debts in respect of taxes, taxes-or contributions to the consolidated general budget (local budget, state budget, etc.) at the time of submission; (2) The judicial record of the economic operator and the members of the administrative, management or supervisory body of that economic operator or those having power of representation, decision-making or control within it, as evidenced by the certificater) issued by O.NR.C./ constitutive act; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

Information and formalities necessary for evaluating if requirements are met:

Economic operators must proveis a form of registration under the law of the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment, and that he has the professional capacity to perform the activities that do subject of the contract. It will be completed by the economic operators participating in the attribution procedurewith information about their situation. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively the certifying certificate issued by O.NR.C. or, in the case of foreign tenderers, equivalent documents issued in the country of residence are to be loaded in SEAP, at the request of the contracting authority, only by the bidders placed on the first two places in the country of residencethe intermediate statement drawn up at the completion of the evaluation of the tenders, according to art. 196 par. (2) of the Law no. 98/2016 on Public Procurement

The information in the Certificate of Assurance must be valid / valid at the date of its submission.
