Description of the subject of the order can be found in Attachment 3a to the Terms of Reference - conditions for the subject of the order are included in Annex 9A to the Terms of Reference (common for lots 1-11).

Required deadline for ordering 12 months from the date of the contract, however, not longer than until 31/12/2019.

Contractors, who:

1) can apply for the order, have declared business activity in the field of production, storage, packaging and trade in agri-food products, in accordance with the Act of 21 December 2000 on commercial quality of Artagro-food items,

2) have reported activities subject to official control of the authorities of the State Sanitary Inspection, in accordance with the Act of August 25, 2006 on food and nutrition safety or have reported registered activity related to the production, processing and distribution of products of animal origin, in accordance with the Act of December 16, 2005 on prod

Before awarding the contract, the Contractor, whose offer has been assessed the highest, will be requested to submit in a period not shorter than 10 days, documents valid as at the date of their submission: a) confirmation of the notification to the competent authority of the Trade Quality Inspection of Agricultural and Food Products, starting a business in the field of production, storage, confectionionization and trade in agri-food products, in accordance with the Act of 21 December 2000 on the commercial quality of agricultural and food products;

Confirmation activity is to be applied to parts of the order or type of food (product group) covering the subject of the orders in parts / parts, which offer is submitted;

b) current decision or certificate of the competent authority of the State InspSanitary Section, in accordance with the Act of August 25, 2006 on food and nutrition safety regarding entry in the register of establishments or on the approval of a plant subject to official control of the State Sanitary Inspection in the production (if the Contractor is a producer) of storage, confectioning and marketing agri-food or storage products, koprocessing and trade in agri-food products (if the Contractor is not a producer) or valid decision or certificate of the competent Veterinary Inspection body, in accordance with the Act of 16 December 2005 on products of animal origin regarding registration or approval of the establishment conducting the sale direct products of animal origin (with indicatediem products coming from the plant that can be placed on the market in the territory of the Republic of Poland), the activity covered by the decision is to refer to the part of the order or type of food (product group) covering the subject of the order in the parts / parts on which the offer is made; be issued not earlier than 12 months before the deadline for submission of offers. If the documentt was issued in a later period than indicated above, the Contractor is obliged to attach to the document a statement that the information contained in the document is valid and have not changed on the day of the deadline for submitting bids. c) in case the offer is submitted by the Contractor from the European Union, from outside the Republic of Poland, the offer should be accompanied by the current decision issued by the competent authority of the relevant countryabout the establishment's approval of the part of the order or type of food (product group) including this part of the order together with the veterinary ID number in the case of food (product group) of animal origin;

d) if the offer is submitted by third country bid to the offer attach the current decision issued by the competent authority in your country fromleaving the plant for production and for export to the markets of other countries (including the European Union countries) in the scope of the order or type of food (product group) including this part of the order.

Contractors who have adequate liability insurance, ie are insured against civil liability (tort, contractj) within the scope of business related to the subject of the order for a guarantee sum at least:

a) PLN 480, 000 in the case of submitting an offer for Lot No. 1 - Deliveries of fresh vegetables and fruits

b) PLN 25, 000 for submitting an offer for Part 2 - Deliveries fresh seasonal fruit

c) PLN 330, 000 for submitting an offer for Lot No. 3 - Deliveries of milk and milk products

d) 280, 000 fromin the case of bid for Part 4 - Deliveries of foodstuffs for general nutritional purposes

e) PLN 60, 000 in the case of submitting an offer for Part No. 5 - Deliveries of food products for special nutrition (baby food)

f) PLN 240, 000 in the case of an offer for Lot No. 6 - Deliveries of meat and sausages

g) PLN 170, 000 in the case of submitting an offer for Part No. 7 - Deliveries-frozen vegetables and fruits

h) PLN 50, 000 for submitting an offer for Lot No. 8 - Deliveries of frozen fish fillets

i) PLN 40, 000 for submitting an offer for Lot No. 9 - Deliveries of fresh fish fillets

j) PLN 35, 000 for submitting an offer for Lot No. 10 - Deliveries of freshly baked bread on natural sourdough

k) PLN 30, 000 in case of placing an offer for Part No. 11 - Deliveries of eggsPLN 18, 000 in the case of submitting an offer for Part No. 12 - Deliveries of natural springs with the lease and service of distributors dispensing heated and chilled natural water from containers. The fulfillment of the condition for participation in the proceedings must be shown separately for each part on which the there is an offer (if you bid for more than one part of the order andwillingness to present the same liability policy for all parts of the order, the condition of participation in the procedure specified for these parts should be summed up, however, the Employer does not require a liability policy for a guarantee sum higher than PLN 1, 000, 000 regardless of the number of parts of the order for which the offer is submitted. The values given in the documents confirming the fulfillment of the condition in currenciesother than PLN, the Contractor will calculate according to the average exchange rate of the National Bank of Poland (Table A), on the day of the deadline for submitting bids.

Before awarding the contract, the Contractor whose offer has been evaluated at the most, will be requested to submit in a period not shorter than 10 days, documents valid at the day of their submission: - Documents confirming that the Contractor is insured against civil liability in the scope of pIf, for a justified reason, the Contractor can not submit the documents required by the orderer referred to above, the contracting authority allows the contractor to submit other documents that sufficiently confirm fulfillment of the condition of participation described by the contracting party wp- 1. The order of documents which the order requires with the offer Ordering party:

a) Proof of payment of the bid bond - correspondingly to the part on which the bid is submitted

b) Completed tender form

c) Completed price calculation - for the part on which an offer is made

d) Photocopies of labels of offered items or other documents - quality system

2.O the award may apply-Contractors who are not subject to exclusion based on: art. 24 section 1 items 12-23 and art. 24 sec. 5 pts 1-8 PZP and for the purpose of preliminary monster one should present: the axis in the form of a single document, ie EAT. EAT should be submitted in electronic form with a qualified electronic signature.

3. Before awarding the contract, the Contractor whose offer has been evaluated the highest, will be called toplacement in a period of not shorter than 10 days, the following documents valid as at the date of their submission:

1) in order to confirm the lack of grounds for exclusion Ordering requires submission of documents and statements referred to in point 9.3.1 of the ToR - in accordance with - 5 of the Regulation. The Minister of Development of 26 July 2016 regarding documents that the contracting authority may request from the contractor in the procurement procedurea (Journal of Laws of 2016, item 1126).

2) to confirm the circumstances referred to in art. 25 ust. 1 point 2 of PPL:

a) and in the entity authorized to control the quality of the monies, that the delivered products meet certain standards or technical specifications, and if the Contractor does not have the arguments that the offered agri-food products meet the requirements in terms of trade qualityspecified in the regulations on commercial quality and additional requirements for these articles if their fulfillment has been declared by the producer b) or decision or opinion of the competent authority of the State Sanitary Inspection or Veterinary Inspection authority about exercising supervision over the implementation of the principles of the implemented HACCP system or principles of Good Practice Production not issuedthan 12 months before the deadline for submission of tenders. The submitted certificate should confirm that the Contractor has implemented and applies the principles of the HACCP system or applies the principles of Good Manufacturing Practice, the legal basis of art. 59 and 73 of the Act of August 25, 2006 on Food Safety and Nutrition. The Employer also allows the submission of another document, i.e. a current certificate ofan independent entity (a certification body accredited by the Polish Center for Accreditation) confirming the implementation of the HACCP system or the principles of Good Manufacturing Practice (GMP). c) In the case of submission of the offer for lots 4, 7 and 8 - Photocopies of labels (for each of the price calculations) offered articles or other documents (product specifications) containing information originatinge directly from the manufacturer about the subject matter of the order in the scope referring to the requirements of the Ordering Party specified in the subject description of the order for a given part - each attached document should be marked with the number of the position of the price calculation

d) In the case of submission of the offer for lot No. 12 - Current certificate issued on (or other document) confirming the implementation of the management systemand quality in accordance with ISO 9001: 2008 or newer in the scope of production / bottling offered by the Contractor of source water. e) In the case of submitting an offer for lot No 12 - Certificate issued by the National Institute of Public Health - National Institute of Hygiene containing assessment and generic qualification offered water; the water offered must meet the requirements set out in the Minister's OrdinanceOf Health of 31 March 2011 on natural mineral waters, source waters and table waters (Journal of Laws of 2011 No. 85, item 466).
