1. The subject of the order is the gradual delivery of office materials to the headquarters of the Regional Department of the Military Property Agency in Szczecin, ul. Potulicka 2.

1. For grantingThe contractor who is not subject to exclusion in the circumstances referred to in art. may apply for the contract. 24 paragraph 1 of the Act.

2. The preliminary confirmation of the lack of grounds for excluding the Contractor from participation in the procedure will be the offer together with the offer in the form "EAT" (Annex 5 to the ToR) in Part III "Grounds for exclusion".

Part A statements submitted together with the offer

1. Artist fromis obliged to submit an offer on the form whose template is attached as Annex 2 to the ToR.

2. The Contractor is obliged to attach to the offer, valid as at the day of submitting the bids, a statement in the form of "EAT", in order to pre-confirm that the Contractor is not subject to exclusion from the procedure pursuant to Article 24 (1) of the Act, the model of which is Annex 5 to the ToR: Part B statements and documentyou submitted at the request of the Employer

3. Before awarding the contract, the Awarding Entity will call the Contractor whose bid is highest rated to submit statements or documents valid as at the date of submission of the grounds for exclusion from the proceedings:

(in the case of Contractors jointly applying for the award of the order, the statements and documents shall be submitted by each of the Contractorsjointly)

1) in relation to the circumstances specified in art. 24 paragraph 1 of the Act:

a) information from the National Criminal Register in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act issued not earlier than 6 months before the deadline for submission of bids;

b) the Contractor`s statement that he has not issued a final court judgment or final administrative decisionon arrears in the payment of taxes, fees or social security or health insurance contributions or in the event of such a judgment or decision on documents confirming the payment of these claims or the conclusion of a binding agreement on the repayment of these claims, a specimen statement is attached as Annex 6 to the ToR;

c) statements Contractors about the lack of a decision against him by titlepreventive measure of the prohibition to apply for public procurement, the specimen declaration is attached as Annex 7 to the ToR;

In accordance with art. 13 section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general data protection regulation) (Journal of Laws EU L 119 of 4.5.2016, p. 1), hereinafter referred to as "GDPR", I would like to inform you that:

1) the administrator of your personal data is Agencja Mienia Wojskowego with its registered office at ul. Nowowiejska 26 A, 00-911 Warszawa;

2) The administrator has appointed a Data Protection Officer with whom you can contact in matters related to data protection via e-mail.to the address: iod@amw.com.pl or by post to the address of the Military Property Agency, ul. Nowowiejska 26A, 00-911 Warsaw, with the note "Data Protection Inspector;

3) your personal data will be processed on the basis of art. 6 clause 1 lit. c GDPR for the purpose related to the procedure for the award of a public contract;

4) recipients of your personal data will be persons or entities to whom it will be disclosedie documentation of proceedings based on art. 8 and art. 96 section 3 of the Act of 29 January 2004 Public Procurement Law, hereinafter "Public Procurement Law";

5) your personal data will be stored, in accordance with Article 97 (1) of the Public Procurement Law, for a period of 4 years from the date of termination of the proceedings regarding awarding the contract, and in the case of the content of the contract for a period of 10 years or longer in the case of a contract concluded in partas over 10 years, then for its duration;

6) your obligation to provide your personal data directly regarding you is a statutory requirement specified in the provisions of the Public Procurement Law, related to participation in a public procurement procedure; the consequences of not providing specific data result from the Public Procurement Law;

7) with regard to your personal data, there will be no decisionsare undertaken in an automated manner, applying to Article 22 GDPR;

8) you have:

a) pursuant to art. 15 GDPR, the right to access your personal data concerning you;

b) pursuant to art. 16 GDPR, the right to rectify your personal data (exercising the right to rectification may not result in a change in the outcome of the public procurement procedure or a change in the provisions of the contracty to the extent not in accordance with the PPL Act and may not violate the integrity of the protocol and its annexes);

c) pursuant to art. 18 of the GDPR, the right to request the administrator to limit the processing of personal data, subject to the cases referred to in art. 18 clause 2 GDPR (the right to limit processing does not apply to storage in order to ensure the use ofe measures of legal protection or to protect the rights of another natural or legal person, or due to important reasons of public interest of the European Union or a Member State);

d) the right to lodge a complaint with the President of the Office for Personal Data Protection, if you consider, that the processing of your personal data regarding violates the provisions of the GDPR;

9) you are not entitled to:

a) in connection withrt. 17 clause 3 lit. b, d or e GDPR, the right to delete personal data;

b) the right to transfer personal data referred to in art. 20 GDPR;

c) pursuant to art. 21 GDPR, the right to object to the processing of personal data, because the legal basis for the processing of your personal data is Art. 6 clause 1 lit. c GDPR.
