Delivery of medicinal products of 704 nomenclature units, described in detail in technical annex 1 to the technical specification, which is part of the documentation for participation in the procedure approved by the contracting authority.

1. The participant shall be registered as a trader within the meaning of Art. 1 of the Commercial Law.

2. The participant should be entitled to trade in medicinal products within the meaning of the CLPM.

3. Participant offeringthe supply of medicinal products requiring an import authorization should be subject to such a valid authorization, issued in accordance with the LPPM.

4. A participant offering to supply medicinal products containing narcotic substances shall be licensed under Art. 32 of the LCNSP.

The circumstances under items 1 to 4 are described in Part IV "Selection Criteria", letter A "Eligibility", item 1) of the OEDO.

Proof:

In the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the Public Procurement Act, copies of valid documents shall be submitted by the participant: wholesale trade authorization for medicinal products issued by the BDA or other document certifying his right to trade medicinal products issued by the competent authority of the respective country; import authorization (where applicable); license under art. 32 ofLCND or similar document issued by the competent authority of the country concerned (where applicable)

1. The contracting authority shall remove from participation in a procurement procedure a candidate or tenderer for whom any of the circumstances under Art. 55, para. 1, items 1, 3, 4 and 5 of the Public Procurement Act. The circumstances are described in detail in the document approved by the contracting authorityin section III, items IV.1.8 to item IV.1.11

2. Upon conclusion of the contract, the contractor shall submit a performance guarantee, which shall amount to 3% of the estimated value of the contract excluding VAT, calculated on the basis of the product prices and estimated consumption indicated in the tender. the technical specification approved by the contracting entity.

3. The guarantee shall be for a period of not less than 13 (thirteen) months.

4. Where a bank guarantee is presented, it shall contain a condition for unconditional and irrevocable payment after the written request by the contracting authority.

5. If the guarantee is presented in the form of a monetary amount, it should be deposited into the bank account of the contracting authority in BGN at DSK Bank: IBAN BG16STSA93000026690031; BIC STSABGSF.

6. The conditions for absorption and return of the guarantee are described in the draft contract representing section VI of the documentation approved by the contracting authority for participation in the procedure.
