The economic operators submitting the offer must prove a form of registration under the law of the country of residence, to show that the economic operator is legally constituted, that it is not in any of the situationsit is annulment of the constitution as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract.

Method by which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation.

The supporting documents proving the fulfillment of those assumed bythe completion of the DUAE, respectively the certifying certificate issued by the ONRC, or in the case of the foreign bidders, equivalent documents issued in the country of residence, will be presented, at the request of the contracting authority, by the bidders ranked on the first, second and third place in the intermediate ranking drawn up at finalizing the evaluation of the offers.

In the situation where from the documents requested in this regardit does not appear that the bidder is authorized to carry out activities that are the object of the acquisition, a condition regarding the capacity to exercise the professional activity (registration) will be considered unfulfilled and the offer unacceptable based on art. 134-137 of the GD 395/2016. wholesale distribution issued by the Ministry of Health through the National Agency for Medicines and DMedical devices, regarding the authorization of the activity of marketing of drugs. - Proof of approval of the unit for procurement / marketing activities, activities of holding (storage) / handling, delivery / transport under contract, of medicinal products for human use by presenting the Wholesale Distribution Authorization issued by MS ANM.

Legal basis of the authorization: Law no. . 95/2006 looknd the reform in the field of health - Title XVII, Medicine, Chapter VII, art.787-796, with the subsequent modifications and completions and the Order of the Minister of Public Health no. 1964/2008 for the approval of the norms regarding the establishment, organization and functioning of the wholesale distribution units of medicinal products for human use.of the authorization, following that the supporting documents (as the case may be equivalent in the case of foreign bidders) requested in support of the requirement to be presented by the op. economic ranked 1st; II and III in the intermediate ranking, having the obligation to present them at the request of the contracting authority, at the end of the evaluation of the offers.

The technical and / or professional capacity of a bidder / candidatet is evaluated based on similar experience, skills, efficiency and effectiveness, results from analyzing the information presented during the award procedure by which the economic operator demonstrates that he has the capacity necessary for the fulfillment of the contract in question.
