1.) Requirement:

The bidders participating in the procedure will prove the non-compliance in the prevailing situationsto art. 59, 164, 165 and 167 of Law no. 98/2016 on Public Procurement.

1.) Proof of Provenance:

The European Unique Acquisition Document (DUAE) will be completed with respect to non-compliance with the exclusion situations provided for by national law (including third-party supporters and subcontractors, if the case). Note 1: Required for both the associated bidder and the supporting third party-or the subcontractor. Note 2: If the third party / third party, the subcontractor / subcontractor falls within one of the grounds for exclusion provided in Art. 59, 164, 165 and 167, the contracting authority shall request once only that the economic operator to replace the supporting third party / supporter / subcontractor / subcontractor respectively; Considering the provisions of art. 196 of Law 98/2016 at the request of the contracting authority, will be filled in and attached by the operators ranked on the first three places in the intermediate rankings drawn up at the completion of the evaluation of the tenders, the following: a). the criminal record certificate of the economic operator and the members of the management, management or supervisory body of the economic operator and / or those having the power of representation;it is the decision or control within it as it results from the certifying certificate issued by ORC / constitutive document or, as the case may be, documents proving that the economic operator may benefit from the derogations provided by art. 166, par. 2, art. 167, par. 2, art. 171 of Law no. 98/2016 on public procurement.

In the case of an association, the certifier will be presented by eachis associated in part.

b). documents issued by the competent legal authorities stating that the tenderer has fulfilled its obligations to pay the taxes and duties to the consolidated general budget as well as the local taxes in accordance with the legal provisions in force in Romania or in the country where it is established, in original, legalized copy or legible copy with cf cu original (scanned), for Romanian legal persons, respectively original or copy cf. with the original and translated into Romanian (scanned), in the case of foreign legal persons.

In the case of an association the certificates will be presented by each individual partner. Note: The Fiscal Attestation Certificate / Certificate of Local Taxes and Fees must show that the tendereru has outstanding debts at the moment of their presentation following the request submitted by the contracting authority in accordance with the provisions of art. 196 of the Law no. 98 / 2016.The payment of taxes is done by presenting the standard forms issued by the competent bodies regarding the fulfillment of the payment obligations. Tenders submitted by economic operators with unpaid debt cthe state budget or the local budget, and who have not received incentives / rescheduling to pay these debts (taking into account the maturity of their payment), will be disqualified / rejected.

2) Requirement:

The bidders participating in the procedure will proves the non-compliance in the situations provided in art. 60 of Law no. 98/2016 on public procurement.

In order to prove the non - compliance ofthe applicant in the situation of a conflict of interest shall be communicated in the following list of the decision-makers within the contracting authority, regarding the organization, carrying out and finalization of the award procedure:

Economic operators will send the answers to the clarifications and any requested documents during the evaluation of the offers through the SEAP, 5) Attached to the Tender Specifications list of the product estimates for 36 months. For each batch it was stated:
