Amount estimated frame agreement: minimum: 750, maximum: 1 600 tablets.

Information and formalitiesrequired to assess compliance:

1. Tenderers, third parties and subcontractors must not find themselves in the situations provided for in art. 164, 165, 167 of Law no.98 / 2016

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operators participating in the procedure (including potential third parties and subcontractors)-with the information related to their situation.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, only by the tenderers placed on the first 3 places in the intermediate rankings drawn up at the completion of the evaluation of the bids for each lot, respectively:

- certificate issued by ANAF pentailing the absence of overdue debts in respect of the payment of taxes, duties or contributions, at the time of filing,

- documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement, if applicable, - the criminal record of the economic operator andmembers of the management, management or supervisory body of the respective economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act. Tenderers, third parties and subcontractors should not find themselves in the situations referred to in art. 60 of the Acta no. 98/2016. Will be filled in the Declaration on non-compliance in situations potentially generating conflict of interests, according to the provisions of art. 60 of Law no. 98/2016. This statement will be presented with DUAE by all operators.

the tender must prove a form of registration under the law of the country of residence, the economic entity is legally constituted, it is not in any of the situations of cancellation of establishment and the fact that it has the professional capacity to perform the activities that are the subject of the contract.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE the economic operators participating in the award procedure with the relevant information

The supporting documents proving the fulfillment of the assumed by the completion of the DUAE, respectively the certifying certificate issued by the ONRC, or in the case of the foreign tenderers, equivalent documents issued in the country of residence shall be presented at the request of the contracting authority only by the tenderers ranked in the top three places in the intermediate standings, after finishing the stageelectronic auction.

The framework agreement will be concluded with a maximum of 3 economic operators. The assignment of the three economic operators with which the framework agreement will be concluded will be made according to the lowest bid price of each of them. If the number 1, 2 or 3 are more economic operators with the same price, their classification will be made by re-embossing in the envelope inchis, mentioning that the reopened price is not less than or equal to the price of the top-ranked supplier.
