Requirement No. 1:

The tenderers, including potential third parties and subcontractorsmust not be found in the situations provided for in art. 164, 165, 167 of Law no. 98/2016. Tenderers, including potential third parties and subcontractors, are required to complete and present the DUAE as the first proof of non-compliance in exclusion and capacity requirements.

Mode of accomplishment:

The manner by which the fulfillment of the requirement can be demonstrated:-will complete the DUAE by economic operators, participants in the award procedure with the information related to their situation. At the completion of the DUAE, the participating economic operators will also take into account the notification of ANAP no. 240 / 2016.

The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the-the bidder placed on the first place in the interim ranking made at the completion of the tender evaluation (according to article 66 of GD 395/2016 and article 196 paragraph (2) of Law 98/2016), as follows:

- the criminal record of the economic operator and of the members of the management, management or supervisory body of that economic operator or those having the power to represent, decide orcontrol over it, as evidenced by the certifying certificate issued by the ONRC / Act of incorporation, - a certificate regarding the lack of debts regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget) at the moment of presentation the tender, - where appropriate, documents demonstrating that the economic operator can benefitby the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; other editing documents, as appropriate, - Foreign legal / natural persons wishing to participate in the procedure will present any editorial and equivalent documents issued by the competent authorities of the country in which they are resident to prove otherwisefilling in the outstanding tax and social security obligations at the time of their presentation accompanied by the translation into Romanian.
