The quantities are conIn order to demonstrate the fulfillment of the qualification criteria / requirements, the following will be presented: • The sole bidder / the associated tenderer / the subcontractor / the supporting party must prove that they do not comply with the provisions of art. 164, 165, 167 of Law no. 98 / 2016.

In this respect, the Sole Bidder / Associate Bidder / Subcontractor / Supporter Tertiary will complete DUAE - PaPart III "Exclusion Grounds" - Section A "Reasons for Criminal Offenses", Section B "Reasons for Paying Taxes or Social Security Contributions", Section C "Insolvency, Conflicts of Interest or Professional Misconduct".

Also, the bidder ranked first after applying the award criterion on admissible bids, previously atof the contract, shall present, at the request of the Contracting Authority, the following editorial documents proving / confirming non-compliance with the situations provided in art. 164, 165, 167 of Law no. 98/2016, both for the sole tenderer / associated bidder and for the subcontractor / third party stated in the offer:

- the criminal record of the economic operator and the members of the organmanagement or supervision of the respective economic operator or those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / act of incorporation, - a certificate of fiscal attestation regarding the fulfillment of the obligations to pay the taxes, taxes or contributions to the general consomitted, from which to show the lack of overdue debts at the moment of presenting this certificate,

- certificates / records / editorial documents proving / confirming non-compliance with the situations provided by art. 167 par. (1), both for the sole tenderer / associated bidder and for the subcontractor / third party stated in the offer, - editorial documents demonstrating the factthat the sole tenderer / associated bidder, as well as the subcontractor / third party declared in the offer, fall within the provisions of art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement (if applicable), - other editorial documents, as appropriate.

Foreign legal persons shall present any editorial documents issued by the authorized institutions(fiscal attestation certificates, criminal records, other equivalent documents, etc.) proving that they have fulfilled their obligations to pay taxes, duties or contributions to the general consolidated budget in accordance with national law of the country of residence of the sole vendor / associated offeror / subcontractor / third partyhave the country where the single bidder / associated bidder / subcontractor / third party is established. From the editorial documents submitted, there must be a lack of overdue debts at the moment of their presentation.

The sole bidder / the associated offeror / the subcontractor / the supporting party will submit a declaration on the conflict of interests, in accordance with the provisions of art. 60 par.-(1) lit. a), lit. d) and lit. e) of Law no. 98/2016 on public acquisitions, with subsequent amendments and completions. Form No. 3 of the "Forms" section of the Awarding Documentation, stamped and signed by the legal representative of the tenderer and submitted by the Single Tender / Associated Offeror / Subcontractor / Supporter Trial once(IV) Persons holding decision-making positions within the Contracting Authority as well as persons within the Contracting Authority who may influence the content of the awarding documentation and / or the award procedure are:

The tenderer must demonstrate that the average annual turnover for the last 3 years (2015, 2016, 2017) was at least RON 1 200 000. 1) Duration of the contract is 18 months from signature by both parties; 2) In order to complete the DUAE, bidders will access the dedicated on-line service, made available free of charge by the European Commission, available at-Internet: https: //ec.europa.eu/growth/tools-databases/espd/filter and https://ec.europa.eu/tools/espd

4) Before contacting the Council or the Court of Justicecompetent person, the person who considers himself / herself injured has the obligation to notify the contracting authority of the request for remediation, in whole or in part, of the alleged violation of the public procurement legislation or the concessions, within the term stipulated by the legislation, starting with the day following the taking of knowledge of the act of the contracting authority considered unlawful. Within-3 days calculated from the day following the receipt of the prior notification, the contracting authority shall provide a response indicating whether or not to take steps to remedy the alleged violations. If the contracting authority sends an answer in the sense that it is to take remedial action, it shall have a period of 7 days for the implementation of thetheir effectiveness. The person who considers himself or herself to be prejudiced by the answer given to the prior notification or who has not received any response within the above 3-day period and any person who considers himself / herself injured by the remedial measures taken by the contracting authority may refer the matter to the Council for annulment of the act contracting authority, its obligation to issuean act or the taking of remedial measures, as well as for the recognition of the claimed right or legitimate interest, within the period provided by the law.
