The present march, goes through procedure negotiated with prior call for competition, relates to the supply of 95 E 10 unleaded petrol for motor vehicles, in accordance with NBN EN 228 automotive fuel standardspetrol 95 E 10 (Royal Decree of 18 October 2001), low sulfur content, as described in the technical clauses of the present special specifications.

The market regulates supplies for a period of 4 years, starting on 17.2.2020 to end on 16.2.2024. The quantity of gasoline to be delivered for this period is estimated at 1 250 000 l. The overall quantity to be supplied, indicated above, isoximative and refers to deliveries in tanker of capacity to be agreed, in 2 deposits of the TEC, on the dates fixed by him, according to confirmatory orders addressed by telephone or fax as and when necessary.

The modalities of delivery detailed in the technical clauses of the present special specifications.

By the submission of its tender, the tenderer accepts, withoutreserves, to deliver the quantities which will be ordered to him, whoever they are and without right to a particular compensation in the case where the quantity mentioned above as an indication would not be reached.

The DUME certifies that the tenderer does not not in one of the exclusion cases referred to in Articles 67 to 69 of the Public Procurement Act of 17 June 2016.

(a) Reasons for exclusionmandatory exclusion

The offer form must be accompanied by an extract of a criminal record (less than 3 months) from which it results that the tenderer has not been the subject of a sentence pronounced by a judicial decision having force of suspected of involvement in criminal organization, corruption, fraud, terrorist offenses, terrorist offensesor incitement to commit such an offense, complicity in or attempt to commit such an offense, money laundering or the financing of terrorism, child labor and other forms of human trafficking, the occupation of third-country nationals while illegally residing. Article 67 and 151 of the law of 17.6.2016 on public markets and Article 67 of the royal decreeof 18 June 2017 concerning the award of public contracts in the special sectors, the contracting authority shall, at any stage of the procedure, exclude a tenderer from participation in the award procedure, where he has established or he is otherwise informed that the tenderer has been the subject of such a conviction.Iscales and Social

In accordance with Articles 68 and 151 of the Law of 17.6.2016 on public markets and Article 68 of the Royal Decree of 18.6.2017 on the award of public contracts in the special sectors, the power the contracting authority shall, at any stage of the procurement procedure, exclude the participation in a procedure from a tenderer who does not satisfy hisobligations relating to the payment of taxes and social security contributions except: (1) where the amount outstanding does not exceed EUR 3, 000; or (2) who has obtained payment terms for this debt which he strictly observes; or (3) where the tenderer can demonstrate that he has, in respect of a contracting authority or a public undertaking, certainand free of any commitment to third parties. These receivables amount to at least an amount equal to that for which he is late in paying tax or social security debts. This latter amount is reduced by the amount of EUR 3 000.

The contracting authority, however, gives the opportunity to any economic operator to comply with these social and fiscal obligations in court.the first time the candidate or tenderer failed to meet the requirements. On the basis of this finding, the contracting authority leaves the economic operator a period of 5 working days to provide proof of its regularization. The use of this regularization is only possible once. This delaythe contracting authority shall verify the situation with regard to the social debts and the tax situation of the tenderers, on the basis of the certificates which are available electronically for the contracting authority via the Telemarc application.

(c) Other grounds for exclusion

In accordance with Articles 69 and 151 of the Act of 17.6.2016 on public procurement, the contracting authority may, at any stage of the procurement procedure, exclude from participation in a procedure a tenderer in the following cases: (1) where the contracting authority can demonstrate, by any appropriate means, the candidate or tenderer has failed to fulfill the applicable obligations in the fields of environmental law, al and labor, referred to in Article 7 of the aforementioned Act;
