The procedure is aimed at stipulating an Agreement for each Lot, pursuant to the art. 26 Law n. 488 of 1999 and s.m.i. and art. 58 L. n. 388 of 2000, for the assignmentsupply of automotive fuel and heating oil at the offices of the Public Administrations. For more details, refer to the tender documentation.

The participation of the subjects pursuant to art. 45 of Legislative Decree no. 50/2016 with the procedures referred to in art. 47 and 48 of Legislative Decree no. 50/2016 on the following conditions:

a) the general requisites are indicated in paragraph 6 of the Tender Regulations;

b) the eligibility requirements are indicated in paragraph 7.1 of the Tender Regulations.

A) the economic capacity requirements are indicated in paragraph 7.2 of the Tender Regulations.

Each operator electsdomicile, also pursuant to art. 52 of Legislative Decree no. 50/2016, in the area of the system dedicated to it and to the e-mail address indicated in the application for participation.

In the event that, before the expiry of the term of the agreement, even if extended, the maximum quantity is exhausted, Consip SpA reserves the right to ask the contractor, at the same terms, prices andconditions, to increase it up to 2 fifths pursuant to art. 27, paragraph 3, of the Ministerial Decree 28/10/1985. As better clarified in the Tender Regulations, operators will be asked to produce for each Lot:

i) provisional guarantee pursuant to art. 93 of Legislative Decree no. 50/2016, whose quantification is indicated in the tender documentation;

ii) final guarantees pursuant to art.103 of Legislative Decree no. 50/2016 referred to in paragraph 21.2 of the Specifications;

iii) insurance policy;

iv) guarantees for audits.

Each lot is provided with basic auction prices subject to discount, as better specified in the tender documentation.

The tender will be awarded on the basis of the economically most advantageous offer based on the lowest price. Thesubcontracting within the limits and with the methods indicated in Legislative Decree no. 50/2016 and in the Disciplinary. With reference to point II.1.6) This contract is calledlots in lots: yes - Offers must be submitted for a maximum number of lots: 18 - Maximum number of lots that can be awarded to a bidder: 5 for lots from 1 to 9; 5 for lots from 10 to 18, as better specified in the tender documentation.

With reference to point IV.2.6) The offer must be valid for 240 days from the deadline for receipt of tenders.
