The supplier will deliver the goods to the pre-specified in the specifications, according to the terms of the contract. The supplier also has the obligation to install, configure, test and commission, followed by training of the personnel made by the supplier's specialist.

Main Site: Contracting authority's office. an intravascular ultrasound investigation system and intracoronary pressure control in the required configuration(including Associates / Subcontractors / Third Parties) are obliged to complete and present the initial DUAE as the first proof of noncompliance with exclusion (see DUAE User Guide developed by ANAP available at www. anap.gov.ro). Bidders will respond within the DUAE by "yes" or "no" if they fit in situatiil(including the associate / third party supporter, as the case may be) will reject it as unacceptable.

The supporting documents proving the fulfillment of the assumed non-compliance with exclusion situations are to be submitted at the request of the authority contracting entity, only by the bidder ranked I in the interim rankingThe documents issued in a language other than the Romanian language will be presented in the language in which they were issued, accompanied by an authorized translation in Romanian. All documents will have, besides the signature, clearly mentioned the full name of the signatory.

Requirement 1 - Failure to comply with the provisions of art. 164 of Law no. 98/2016

Ofertantul / association leader or associates or third party bidders of the bidder do not fall within the exclusion situations provided for in art. 164 of the Public Procurement Law 98/2016.

Requirement 2 - Non-compliance with the provisions of art. 165 of Law no. 98 / 2016.

The bidder / associate leader or associates or third party bidders did not breach their obligations regarding the payment of taxes, axes or contributions to the consolidated general budget, no court decision or administrative decision being final and binding in accordance with the law of the state in which the economic operator is established - Requirement 3 - non-compliance with the provisions of art. 167 of the Law no. 98 / 2016.

Means of fulfilling the requirements: To prove non-compliance in the situations provided by art. 59 60, 164, 165, 167 of Law no. 98/2016, the tenderer placed on the first place in the interim ranking made at the completion of the evaluation of the tenders and, as the case may be, by the third parties and the subcontractors, shall present only at the request of the authorscontracting authorities, the following documents:

Request. The average global turnover for the last 3 financial years ended (2016, 2017, 2018) must be at least equal to:

- RON 545, 000 for bids submitted for Lot 1,

- 270, 000 RON for bids submitted for Lot 2,

- 450 000 RON in the case of bids submitted for Lot 3,

- 414 000 RON in the case of bids submitted for Lot 4,

- 10RON 8, 000 for bids submitted for Lot 5.

The economic and financial capacity of the economic operator can be sustained in accordance with art. 182 of Law no. 98/2016. By firm commitment, the third party / third party confirms that they will / will support the bidder in order to fulfill the contractual obligations, either by specifying how they will concretely intervene to leadby specifying the respective obligations for which he has given the support, or by indicating the financial resources he / she will make available to the bidder (describing the concrete way in which he / she will do so). According to the provisions of art. 184 of Law no. 98/2016, through the firm commitment, the third party / third party will be committed to jointly and severally answer the bidder for the execution of the contract.public prosecution. (2) lit. b) According to the provisions of art. 160 of Law 98/2016, modified by Government Emergency Ordinance 107/2017, economic operators interested in the procedure will ask for clarification or informationAdditional information regarding the awarding documentation 17 days before the deadline for submission of tenders, and according to art. 161 of Law 98/2016, modified by OUG 107/2017, the reply of the contracting authority will be sent 10 days before the deadline set for the submission of tenders.

If it is found that the first ranked offers have equal prices, the authoritythis contractor will ask the operators to submit new prices in SEAP in the "Questions" section of the SEAP.

Tenderers / subcontractors / third parties will complete and sign with an extended electronic signature based on a qualified certificate issued by an accredited certification service provider, all documents submitted to SEAP, including requests for clarification or replyrequests for clarification. We mention that for viewing docum. the attribution attributed to the SEAP economic operators must have a program required to view the electronically signed files (this program being available free of charge on the websites of the electronic signature providers). Correspondence and identification data of economic operators (address, telephone, fax, e-mail, fiscal identification code) will be registered with the DUAE. If the tenderer can not be contacted to carry out the legal formalities for conducting the public acquisition procedure, the responsibility for the consequences arising from it is entirely his responsibility.
