The bidders, third parties and subcontractors must not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer-ranked I in the mid-term ranking of the bid evaluation. These documents are:

1) Certificate of absence of debts regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget) at the moment of presentation showing the lack of overdue debts at the moment of their submission; 2) the criminal recordjudiciary of the economic operator and of the members of the management, management or supervisory body of the economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act ; 3) other editorial documents, as the case may be; 3) Statement of non-complianceprovided in art. 58 (avoidance of conflict of interests) of Law 98/2016.
