Bidders, third parties and subcontractors should not be present in the situations-provided in art. 59, 60, 164, 165, 167 of Law no. 98/2016, with subsequent modifications and additions. The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be filled by the economic operators participating in the award procedure with the information related to their situation.

The declaration on non-compliance in situations potentially generating conflict of interest will be-presented by both bidders and third-party supporters and subcontractors. In the case of submission of a joint offer, the DUAE will be completed by each economic operator. With the submission of the DUAE, the association or subcontracting agreement will be presented (if applicable). The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be presented atthe request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the end of the evaluation of the tenders.

These documents may be:

(a) Certification certificates regarding the lack of overdue debts, taxes or contributions to the consolidated general budget local budget, state budget, etc.) at the time of their presentation,

(b) Cazithe judicial nature of the economic operator and the members of the management, management or supervisory body of that economic operator or of those having the power of representation, decision or control within that operator, as it results from the certifying certificate issued by the ONRC / act (c) Where appropriate, documents demonstrating that the economic operator can-benefit from the derogations provided in art. 166 par. The economic operators submitting the tender must prove a registration form under the conditions the law of the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellationand the fact that it has the professional capacity to carry out the activities that are the subject of the contract.

The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the completed onesDUAE, respectively the certificate issued by the ONRC or, in the case of foreign tenderers, equivalent documents issued in the country of residence shall be submitted, at the request of the contracting authority, only by the tenderer ranked on the first place in the intermediate rankings completed at the evaluation of the tenders. If it is found as a bidthey are ranked first, they have equal prices, the contracting authority will request the re-offer, in order to divide the bids. Tenders will be loaded into the SEAP by a clearly defined deadline (and communicated to tenderers) by the contracting authority. The lowest bidder will be designated the winner. If and after re-listing, the prices offered are equal, then athe contracting authority will ask for a new price offer, until it is possible to make a deduction.
