Free admission for kindergartens from kindergartens with a normal 4 hours authorized / accredited state programte and particulars accredited also for students from primary and secondary school education and particularly from apples within the limit of a daily / preschool / student value. The daily value limit includes the full purchase price of the products, the costs of transport, distribution and storage, as the case may be. The framework agreement will include 1 sub-contract per school year for Lot 17 Zone 5Fruits (apples) and 2 subsequent contracts for the entire period of the 2-year framework agreement. The estimation calendar does not constitute a firm commitment from the contracting authority. Estimates of the min and max quantities that could be requested during the entire framework agreement; min quantity = 1, 003, 122.00 pcs and max quantity = 1, 103, 434.20 pcs. Mandatory requirement for all lots. 1. The economic operator (leader, associate, subcontractor, third party supporter, as the case may be) nomust be found in none of the exclusion situations provided for in art.164, art.165, art.167 of Law no.98 / 2016. Bidders, associated bidders, third party supporters and subcontractors have the obligation to complete and present the DUAE as the first proof of non-inclusion in the situations of exclusion and the fulfillment of the capacity requirements.European question (DUAE), according to the provisions of art.193 of Law no.98 / 2016, by the economic operators participating in the award procedure (leader, associate, third party supporter and subcontractor, as the case may be), supplemented with the information related to their situation ( as mentioned in point VI.3. Additional information). The supporting documents proving the fulfillment of those they assumete by completing the DUAE, will be presented at the request of the contracting authority, only by the bidders ranked on the first 3 places / lot after applying the award criterion on the admissible offers, according to the provisions of art.193-195 of Law no.98 / 2016 and art. 104 paragraph 3 in conjunction with art.65 of the GD no.395 / 2016. These documents can be: - certifying certificate issued by ONRC, record jauditor of the economic operator and of the members of the administration, management or supervision body of the respective economic operator, or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / act constitutive, valid at the time of its presentation, conf. art.194, 196 of Law no.98 / 2016; - heavensubstantiated evidence regarding the lack of outstanding debts regarding the payment of taxes, local taxes and contributions to the general consolidated budget (local budget, state budget, etc.), stating that the bidder does not have outstanding debts at the time of submission, or the value of these debts is within the value thresholds provided in art.166 paragraph 2 of Law no.98 / 2016; - certificateof fiscal record, for legal persons, issued by the National Agency for Fiscal Administration, valid at the time of its presentation; - if applicable, documents proving that the economic operator can benefit from the derogations provided in art.166 paragraph (2), art.167 paragraph (2) and art.171 of Law no.98 / 2016; - other edifying documents, as the case may be. Bidders legal entitiesice / foreign physicists: they will present documents equivalent to all the justifying documents mentioned above, issued by the competent authorities of the country in which they are resident, in accordance with the legal provisions in force in the country of residence. Documents submitted in a language other than Romanian will be accompanied by an authorized translation. The documents will be presented in the languageRomanian, with the mention "in accordance with the original".

2. Conflict of interests.

Mandatory requirement for all lots. 60 of Law no.98 / 2016. The method by which the requirement can be demonstrated:

- the DUAE will be completed by the Economic Operatorsomici (bidder, associate bidder, third party supporter, subcontractor, as the case may be) participating in the award procedure with the information related to their situation,

- will be presented in SEAP with DUAE Declaration regarding the non-compliance with the provisions of art.59 and art.60 of the Law no.98 / 2016 regarding public procurement, related form from Section III Form of the award documentation, by allthe participants in the award procedure (tenderer, associate, subcontractor and third party sponsor, as the case may be).

a) Given that the AC will sign the framework agreement only with op ec located on the 1st, 2nd, 3rd place, as the case may be, the way of dividing the offers with scoreis equal to the following:

1. In case the commission finds that more than 2 admissible offers with equal scores have been submitted / introduced in the SICAP, the AC will request the submission of new improved financial proposals (by 2 decimal places), and op ec will submit their response in SICAP, in which case the framework agreement will be assigned to the first 3 bidders who have the score thatl larger.

2. In case the commission finds that more than 2 admissible offers with equal scores have been submitted by the bidders ranked on the second place, the way of dividing them will be done by requesting the submission of new improved financial proposals (by 2 decimals) in SICAP, and op ec will send their answer, so that the bidder ranked in the first place is not affected, respctiv the new financial proposal is not equal to or lower than the offer ranked on the 1st place. If the new financial proposal improved as a result of the AC request will influence the ranking of the higher places, this will not be taken into consideration, keeping the initial offer filed in SICAP at the procedure.

3. If the commission finds that more than 2 admissible offers have been submittedthem with equal scores by the bidders ranked on the third place, the way of separating them will be done by requesting the submission in SICAP of a new improved financial proposal (with 2 decimals), and op ec will send their answer, so that the bidders ranked on place I and II will not be affected, respectively the new improved financial proposal presented as a result of the request of AC vto influence the ranking of places I and II, this will not be taken into account, keeping the initial offer submitted in SICAP to the procedure. The terms / dates of submission of the new financial proposals will be communicated in the request sent by the AC.on the 1st, 2nd and 3rd place. In case there are no 3 options with admissible offers, the framework agreement will be concluded with 2 options. If there are no 2 options with admissible offers, the framework agreement will be concluded with 1 option. - Form no. 5 before the conclusion of the contract.

D) Any opec has the right to request clarification or additional information, signed with the extended electronic signature, only through SICAP, within a period of no more than 18 days before the deadline for submission of tenders, according to art. 160 paragraph 1 and para. 2 of Law 98/2016, updated. To the extent that requests for clarifications or additional information have been addressed within the stipulated termpreviously, the AC responses will be published in SICAP within 10 days before the deadline for submission of tenders, according to art. 160 paragraph 1 and para. 2 of the Law 98/2016, updating, the AC will not give request request addressed by another communication method or another term than the established one.

E) For the communications regarding the result of the procedure, the contracting authority will send the addresses forrin e-mail, to the e-mail indicated by the bidders in the address of submission of the offer.
