1) The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operators participating in the procedureThe supporting documents proving the fulfillment of the assumed by the completion of the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders. documents may be: (a) certificates of non-disclosure(b) the criminal record of the economic operator and of the members of the administrative, management or administrative body of the company; supervision of the respective economic operator or those having the power of representation, decision or control in the cad(c) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, (d) other editing documents, as the case may be; 2) Statement of Own Responsibilitycomplying with the provisions of art. 58 63 of the Law no. 98 / 2016.

In order to complete this statement we specify that the decision-makers within the contracting entity are:

Initially the economic operators will complete the DUAE (conform art. 193 par. (1) of Law 98/2016). The tenderer placed on the first place in the interim classification made at the completion of the evaluation of the tenders will be obliged to present the supporting documents only at the request of the contracting authority.

According to the Forest Code - Law 46/2008, with subsequent amendments and completions, art. 30 par. (5), regeneration, maintenance of semintisuriloand the plantations are carried out by legal persons certified in accordance with the law.

In this respect, the economic operators submitting the tender must prove a registration according to the law of the country of residence, to make sure that the economic operator is legally constituted, is in any of the situations of cancellation of the establishment and the fact that it has the professional capacitythat is to accomplish the activities that are the object of the contract. The way to prove the fulfillment of the requirement: To complete the DUAE by the economic operators participating in the award procedure with the information related to their situation.

The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively the certifying certificate issued by the ONRCit must be concluded that the object of the contract must have a correspondent in the CAEN code from the certifying certificate issued by the ONRC and "presentation of the document Certificate of attestation according to art. 30 par. (5) of the Forest Code - Law 46/2008, with subsequent amendments and completions for the groups of services provided under art. 6 lit. a) and b) of the Regulation approved by Order 1763/2015, as-the following:

Annual turnover for the last three years (2015 2017) to be at least :

- 149 960, 00 RON - Lot 1,

- 167 240, 00 RON - Lot 2,

- 149 120, 00 RON - Lot 3,

- 139 900, 00 RON - Lot 4,

- 87 660, 00 RON - Lot 5.

The validity period of the offers 60 days from the term(a) The contracting entity has the right to request the tenderers, in exceptional circumstances, before the expiration of the period of validity of the offer, the extension of this period, (b) The bidder has the obligation to communicate the contracting entity whether or not it agrees to the extension of the period of validity of the offer, (c) the bidder who does notagrees to the extension of the period of validity of the offer, it is considered to have withdrawn its offer, without this losing the guarantee of participation.

- Language of the offer - Romanian. All certificates and documents issued in a language other than Romanian will be accompanied by an authorized translation.

If the economic operators participating in the award procedure use-of the rights provided under art. 193 of Law 98/2016 by completing the DUAE, the supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented at the request of the contracting authority only by the tenderer placed on the 1st place. The economic operators can access the DUAE in order to complete the online form through through the site - https: //ec.europa.eu/growth/tools-databases/espd/filter and with the link https://ec.europa.eu/tools/espd. Requests for clarification of potential bidders will be addressed exclusively in SEAP in the "Questions" section of the award procedure conducted by electronic means and the responses to them will be published in the SEAP, in the "Documentation and Clarification" section of the announcement.the contracting entity shall not respond to the requests addressed by another means of communication than the one established in accordance with the provisions of art. 64 par. (1) of the Law no. 98/2016 for the post-submission of tenders.

The Evaluation Committee will forward the clarification requests regarding the submitted offers in the SEAP to the "Questions" section.or sends the answers to the clarifications and any documents requested during the evaluation of the offers through SEAP (the "Questions" section), fully in the section corresponding to the respective request, in the form of one or more separate signed documents / files with an electronic signature. which finds that the first ranked offers have equal prices in the vethe contracting entity (through SEAP in the "Questions" section) will request the re-submission by submitting a new financial proposal .The new financial proposal will be submitted only after the request of the contracting entity. accept the contractual clauses contained in the contract model in the documentationIf there are objections to the proposed contract or changes to the contract clauses or the addition of new clauses, any proposals for modification / completion / removal of contractual clauses will be formulated in writing with justifications and submitted with the qualification documents.
