On the possible requirement of an official decision on the permissibility of theExercise of activity in Austria as well as the obligation according to -- 20 resp. 188 exp. 1 of the Federal Public Procurement Act 2006 are expressly pointed out. Sections 20 and 188 (1) of the Federal Public Procurement Act 2006 oblige applicants or tenderers who are resident in the territory of another Contracting Party to the EEA Agreement or in Switzerland and for the purpose of doing business in Oesterreich have to obtain an official decision regarding their professional qualification, to initiate a procedure as soon as possible, or at least before the expiry of the period for submission of tenders. For regulated trades (- 94 of the Trade Regulations 1994), reference is made in this connection to -- 373 a to 373 e of the Trade Regulations 1994.
