In order to ensure that the contracting authority ensures the quantitative, qualitative and agreed fulfillment of the public procurement contract, a participation guarantee is established for each lotin part, in the amount of 1% of the estimated value of the lot.

The participation guarantee is constituted by a bank transfer to the account of the contracting authority opened at the Treasury of the State Sector 1 on the account RO39TREZ7015006XXX019429 or by a guarantee instrument issued under the law of a banking company or an insurance company, in accordance with the provisions of art. 36 par. (1)of H.G. no. 395 / 2016.

Validity of the guarantee for participation: 160 days

The performance guarantee is constituted within 5 working days from the date of the signing of the public procurement contract

The value of the performance guarantee, in relation to the complexity of the procurement contract which is to be awarded, is 3% of the bidder's bid value-in which the value of the contract is supplemented during the execution of the public procurement contract, the contractor has the obligation to complete the performance guarantee in correlation with the new value of the public procurement contract.

The performance guarantee is constituted by a bank transfer on behalf of the contracting authority, opened at State Treasury Sector 1, account RO39TREZ7015006XXX019429 or through a guarantee instrument issued in accordance with the law by a banking company or an insurance company, in accordance with the provisions of art. 36 par. (1) of H.G. no. 395/2016. The guarantee must be irrevocable. The guarantee instrument must provide that the payment of the performance guarantee will be executed unconditionally, ie at the first request of the beneficiary, based onhis / her statement of guarantor's fault ● The validity period shall be at least equal to the minimum period of validity of the tender, as requested by the awarding documentation ..

The performance guarantee may also be constituted by successive deductions from the amounts due to partial invoices. In this case, the Contractor has the obligation to open an account atthe provision of the contracting authority, to the State Treasury unit within the fiscal body competent to administer it. The initial amount to be deposited by the Contractor in the Disbursement Account so opened is 3% of the price of the public procurement contract, excluding VAT. The provisions of art. 40 par.
