The contracting authority will respond to all requests for clarification before the deadline for submitting bids, 10 days from the deadline for submission of bids.

The number of days to which clarifications may be requested, before the deadline for submitting bids / applications is 15 days.

Bidders, third parties and subcontractors should not be in the situations provided for in art. 164, 165, 167 of Law no. 98 / 2016.

The way to demonstrate the fulfillment of the requirement: the DUAE will be filled in by the economic operatorsbut participants in the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidder placed on the 1st place in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents may be:

With the DUAE, the following documents will be submitted: the firm's firm commitment (together with the annexed commitment documents, -transmitted to them by third party / third party supporters, resulting in the actual manner in which their support will be materialized), the subcontracting agreement and / or the association agreement as the case may be.

If there are two or more offers that contain, within the financial proposal, the same price and are the contracting authority will ask tenderers who have offered the lowest price a new financial proposal in the form of a clarifierdocuments in the SEAP containing new prices, in which case the contract will be awarded to the tenderer whose new financial proposal has the lowest price, as the award procedure is carried out entirely by electronic means.
