1. The subject of the order is "Purchase of specialist measuring equipment and software along with implementation for e-services as part of the Cyfrowe Obserwat projectorium Security of the Silesian Voivodeship - Silesian police closer to the society. "1 The subject of the order is" Purchase of specialized measuring equipment and software with implementation for e-services as part of the project Silesian Security Observatory of Silesia voivodship - Silesian police closer to society ".

1.1 Implementation subject of the orders includes:

a) delivery, installation-and configuration of the hardware and software described in Annex 3 to the ToR,

b) conducting the trainings mentioned in point. IV.4, IV.6 of Annex 3 to the ToR and the instructions mentioned in point. IV.3 of Annex No. 3 to the ToR,

c) testing of the delivered hardware and software and final acceptance,

d) delivery of the As-built Documentation and Operation Documentation.

3.3. Annex No. 3 to the ToR, description of the subject of the order with attachments (OPZ),

4. The parameters given in the SIWZ and attachments to SIWZ are minimum parameters, the Employer allows the option foroffering equipment and software with higher technical parameters.

5. Until the order is picked up by the Ordering Party, the risk of any risks related to possible damage or loss of equipment shall be borne by the Contractor.

6. If the Contractor demonstrates that the offered equipment was withdrawn from the sale or its production was discontinued, there is no access to it on the market.olskie (confirmed by the manufacturer or sales representative on the Polish market). The Employer allows the possibility of offering and delivering other equipment provided that the functionality and performance of the equipment will not be worse than the equipment offered, and the price will not be higher than that offered in the Contractor's offer. The Contractor shall submit the request to change the equipment in writing to the Ordering Party. Youthe Contractor must obtain the Purchaser's consent to change the offered equipment.

9. The Employer requires that the Contractor for the delivered object of the order in all items listed in the description of the subject of the order (Annex 3 to the Terms of Reference) granted a guarantee and warranty service for a period of 60 months from the date of signing the Final Acceptance Protocol. The Employer requires that the Contractor performsFor the employees of the Employer, training for the subject matter of the orders referred to in point IV.4, IV.6 of Annex No. 3 to SIWZ OPZ and free instruction mentioned in point. IV.3 of Annex No. 3 to the SIWZ OPZ. Under the term "Free instruction", the Employer understands the instruction, whose price is included in the total price of the offer, which therefore does not require an additional fee.

11.It requires that the Contractor, in the offer form, indicate in the appropriate tables of the manufacturer and model / name of the assortment and versions of the assortment offered. No indication of the above The data will be treated by the Ordering Party as incompatibility of the offer with the ToR and the bid of the Contractor will be rejected on the basis of art. 89. ust. 1 point 2 of the Act on Public Procurement Law.

13. The orderer requires execution within the framework ofof this order, also other studies regarding the operation of solutions such as programming changes, not mentioned in the Annex. No. 3 to SIWZ - OPZ, which will be required during the implementation or during the period of granted guarantee within the offered programming man-hours. Under the concept of "other studies", the Employer understands, eg: programming changes, the price of which isis the total price of the offer, which therefore does not require additional payment.

14. Whenever in the description of the subject of the order (including attachments), the proper names would appear, this means that the Employer accepts the equivalent product. The Orderer shall consider the assortment of the same purpose as indicated in the Annexes to the ToR and for at least the same extent of use as a valid contractorlity) or higher. Proof of equivalence of the assortment rests with the Contractor.

The Ordering Party requests a security deposit in the amount of 1, 000, 000.00 PLN. The bid bond should be paid in accordance with the provisions of Chapter VI of the Terms of Reference. Contractors, who are not subject to exclusion based on: a) art. 24 sec. 1 point 12 of the Public Procurement Law, b) art. 24 sec. 5 points 1 and 8 of the Public Procurement Law. On confirmationfulfillment of the condition Ordering party demands: (1) on the basis of art. 25a para. 2 of the Public Procurement Law, adding to the offer a statement (a single European order document, hereinafter referred to as EAT) on the lack of grounds for exclusion in accordance with the model constituting Annex 4 to the Terms of Reference, Note. EAT should be sent in an electronic form with a qualified electronic signature. Statements of Contractors pBidders (including each of the Contractors submitting the offer as a consortium and entities providing access to potential) should take the form of an electronic document signed with a qualified electronic signature by each of them to the extent that they confirm the circumstances referred to in art. 22 ust. 1 uPpp. An equivalent requirement applies to EAT submitted by the subcontractorwiec (o) on the basis of art. 25a para. 5 point 1 of the Public Procurement Law. To complete the order of art. 25a para. 2 of the Public Procurement Law, it is sufficient for the EAT to be transferred to the Ordering Party via e-mail, before the deadline for submission of offers. Placing an EAT with an offer on a data carrier (eg a CD, a pendrive) is unacceptable, because it does not constitute its submission using means of communicationelectronic within the meaning of the provisions of the Act of 18.7.2002 on the provision of electronic services. (2) pursuant to art. 26 par. 1 of the Public Procurement Law by the Contractor, whose offer will be highest assessed, at the request of the Employer, declarations and documents regarding the lack of grounds for exclusion listed in Chapter IV B of the Terms of Reference. Other documents making up the composition offerand under pain of nullity in writing. The criteria for the evaluation of offers have been described in detail in Chapter XI of the Terms of Reference. The ordering party will select the most advantageous offer of offers not subject to rejection on the basis of the following criteria: a) gross offer price, 60% weight, which corresponds to 60 points, b) failure removal dates, 30% weight, corresponding to 30 points, c) free work hours pROGRAMMINGe, with a weight of 2%, which corresponds to 2 points, d) protection grade of the offered 3D scanner, with a weight of 4%, which corresponds to 4 points, e) protection level of a tachimeter measuring device with a weight of 4%, which corresponds to 4 points. which corresponds to 100 points which together gives 100%. Before the initiation of these proceedings, technical dialogues were conducted. By completing the recommendations of Article 31d of the Public Procurement Law, the Ordering Party ensures that in conductingthe competition will not be distorted. The Contracting Authority informs that due to the volume of technical dialogue documentation it can be made available for inspection to interested Economic Operators. Wykonawca will be informed by return e-mailm about the date of access to the documentation. The Contractors may consult the documentation of the Contractors' dialogues at any time, in accordance with art. 96 para. 3 Public Procurement Laws. According to art. 24 sec. 11 of the Public Procurement Law Act, the Contractor is obliged within 3 days from the date of publishing information on the website referred to in art. 86 par. 5 of the Public Procurement Law, to be forwarded to the Employerdeclaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 Public Procurement Laws (in accordance with the specimen of Annex No. 6 to the ToR).
