Purchase supplies for Lexmark multifunctional printers and their delivery to ONRC and ORCT headquarters in the county seat. Framework agreement: the estimated minimum value of the agreementof the framework owner: 3 165 822.02 RON excluding VAT; maximum estimated value of the framework agreement: RON 3, 955 675.02, excluding VAT. The estimated minimum and maximum quantities of the framework agreement and the subsequent contracts are presented in Annex 7. The subsequent contracts will be awarded on a quarterly basis depending on the needs of the ONRC and the funds allocated to this destination. The contracting authority willresponds clearly and completely to all requests for clarification on the 11th day before the deadline set for submission of tenders. Number of days until clarifications can be requested before the deadline for submission of tenders: 20 (twenty) days.

Information and formalities necessary to evaluate compliance with the mentioned requirements:

Requirement no. 1: failure to comply with the situations provided in art. 164, 165 and 167 of Law 98/2016 on public procurement. biddersThe members / members of the association / subcontractors / third parties must not be found in the situations provided in art. 164, 165 and 167 of Law 98/2016 on public procurement.

The way in which the requirement can be demonstrated: the bidders / members of the association / subcontractors / third parties will complete the DUAE with the information related to their situation.

Before awarding the contractof the AC, will request the bidders ranked on the first 3 places after applying the award criterion, to present updated supporting documents demonstrating the fulfillment of the qualification criteria, according to the information contained in the DUAE.

The following valid supporting documents will be requested / presented (actual / actual) at the time of presentation:

1) certificateis ascertaining the lack of outstanding debts regarding the payment of taxes, taxes and contributions to the general consolidated budget (local budget, state budget, etc.), at the time of submission;

2) the criminal record of the economic operator, respectively the criminal record for each of the the persons members of the administration, management or supervision body of the respective operationor economic, respectively persons who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the Ministry of Justice Office of the Trade Register / the constitutive document of the economic operator;

3) as the case may be, other documents by which the economic operator demonstrates that it is in exceptional situations that do not lead to exclusionthe procedural area, provided in art. 165 para. (3), art. 166, art. 167 para. (2), respectively art. 171 of Law 98/2016, with the subsequent amendments and completions;

4) as the case may be, any other equivalent building documents, according to the provisions of art. 168 paragraph (1) of Law no. 98/2016, with the subsequent modifications and completions.

In accordance with the provisions of art. 168 paragraph (3) of Law no. 98/2016, with the subsequent modifications and completions, if in the country of origin or in the country where the economic operator is established, no documents of the nature of the above are issued or the respective documents do not cover all the situations provided in art. 164, 165 and 167 of Law no. 98/2016, as subsequently amended and supplemented, a statement will be accepted on its own responsibility or ifin the respective country there are no legal provisions regarding the declaration on its own responsibility, an authentic statement given before a notary, an administrative or judicial authority or a professional association that has competences in this regard.

Requirement no. 2: the bidders, the third-party supporters and the subcontractors must not find themselves in the situations provided in art. 58-63 of the Lawof no. 98/2016. The declaration on their own responsibility regarding the non-existence of the conflict of interests, completed according to the model made available by the contracting authority in the "Forms" section, will be submitted by all the bidders together with the DUAE. :
