1) Bidders, third-party suppliers and subcontractors should not be present in the situations of exclusion provided in art. 164, 165, 167 of Law no. 98/2016 on Public Procurementin which the fulfillment of the requirement can be demonstrated:

The DUAE will be completed by each of the economic operators participating in the award procedure, with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidder ranked first after(a) Certificates of fiscal attestation regarding the fulfillment of the obligations to pay the taxes, taxes and social security contributions to the budgets of the general consolidated budget at the moment of their presentation,

( b) The criminal record of the economic operator and the members of the admi- nistration bodymanagement, or supervision of the economic operator or of those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; (c) Where appropriate, documents which demonstrates that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on Public Procurement, (d) Other editing documents, as the case may be; 2) Bidders, supporting third parties and subcontractors should not find themselves in situations potentially generating conflicts of interest within the meaning of Art. 59 and 60 of Law no. 98 / 2016.

The DUAE will be completed by opeconomic operators (bidders, associate bidders, subcontractors, third parties) participants in the procedure for awarding framework agreements, with information related to their situation. The contracting authority has no the obligation to acquire the minimum or maximum quantity stipulated in the framework agreement / batch. The framework agreement does not represent a firm commitment of the contracting authority, -so that the minimum / maximum conditions will remain at the estimation level, not representing fixed limits. The bidder will prepare the bid for each lot in accordance with the provisions of the awarding documentation and will indicate in its contents which information in the technical proposal and / or the proposal financial statements are classified, classified, or protected by a proprietary rightThe offer is mandatory from the point of view of the content for the entire period of validity established by the contracting authority and assumed by the bidder. The evaluation commission has the obligation to establish the winning bid of the admissible tenders based on the criterion for the award of the public acquisition contract. Any communication, request, information and the like will be uploaded to SEAP and will be signed with an extended electronic signature, based on a qualified certificate, issued by a certification service provider accredited under the law. Without prejudice to the provisions of Law no. 182/2002 regarding the protection of classified information, as amendedthe economic operator shall specify in the tender submitted the information contained in the technical proposal and the financial proposal considered to be confidential, protected by an intellectual property right, insofar as the disclosure of such information would objectively prejudice the legitimate interests of economic operators, especially with regard to seccommercial property and intellectual property
