The subject of the order is: Purchase of medical equipment as part of the project entitled: "Miedziowo Turoszowskie Zagłębie Onkologiczne Poprawathe quality and availability of health services for patients with oncological problems by purchasing modern medical equipment and performing the necessary construction works. "Purchase of medical equipment for the TK

Main Site laboratory: Multispecialty Hospital - Independent Public Health Care Team in Zgorzelec, Lubańska 11-12, 59-900 Zgorzelec, POLAND.

1. Offer evaluation criteria: Oferowthe gross price of the offer is 60%; Technical parameters: 40%. The number of points that can be obtained in the criterion technical evaluation of the subject of the order is included in Annex 3 to the SETC. Form description of the subject of the order.

2. The bid security: PLN 51 800.00. Bid bond paid in the form of: bank guarantee, bank guarantee, insurance guarantee or sureties granted by entities referred to in art. 6bparagraph. 5 point 2 of the Act of November 9, 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2014, item 1804 and 2015, item 978 and 1240), it should be submitted in the original form in the tender offer. The bid security paid in cash should be paid by bank transfer to Bank Millennium SA, No. 55 1160 2202 0000 0001 9259 2053 with the following remark: "Unlimited tender TK-31 / ZP / 2018. 2. meet the conditions for participation in the proceedings regarding technical or professional capacity, which are described in point III.1.3) announcements

3. Zam. will require the Contractor's declaration of affiliation or absence of belonging to the same capital group: Contractor, within 3 days - from the date of placing by the Ordering Party on the websitee of internet information referred to in art. 86 par. 5 Pzp. ie information from the opening of offers - provides the orderer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point) 23 Pzp. (ie a capital group within the meaning of the Act of 16.2.2007 on competition and consumer protection, OJ 2015, item 184, 1618, 1634, as amended), attachment no.-5 to the SIWZ. In the case of belonging to the same capital group - together with the submission of a statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure

4. The Employer will assess whether the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings based on the submitted by the Contractor oprovision in the form of a standard form of a single European order document, hereinafter referred to as a single document or EAT - drawn up in accordance with the model constituting Annex 4 to the ToR and sent to the Ordering party in electronic form with a qualified electronic signature (detailed information, paragraph 9 of the ToR).

5. The Ordering Party informs that EAT can be downloaded from the other sideaddress https://ec.europa.eu/growth/tools-databases/espd/filterlang=en and fill in the required places.

6. The information contained in the EED is a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. Contractor who intends to entrust the execution of a part of the contract to subcontractors in order to demonstrate the lack of grounds for exclusion-participation in the proceedings is submitted by the JEDZ-statement regarding subcontractors.

8. In the case of joint application for contractors, the JEDZ declaration shall be submitted by each of the contractors jointly applying for the order. These documents confirm compliance with the conditions of participation and no grounds for exclusion to the extent that each of the contractors demonstrates fulfillment of the conditions for participation in the proceedings.and no grounds for exclusion.

9. The Contractor who refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion and fulfillment to them, to the extent in which he refers to their resources, the condition of participation in the proceedings - submits JEZ regarding these entities

10. The Employer demands from the Contractor, which relies on the abilities or situation of other entities on the rulesreferred to in Article 22a of the PZP Act, to present documents referred to in items 7.2 and 7.3 with respect to these entities. SIWZ (except for 7.2.6) in accordance with the content of Regulation. on the types of documents that may be requested by the order from the contractor in the contract award procedure (Journal of Laws of 2016, item 1106)

11. Zam. requires the Contractor to present the documents listed in point 7.2. and 7.3. SIWZ, regarding the subcontractor who intends to entrust the execution of a part of the order, and which is not an entity on whose capacity or situation the Contractor relies on the principles set out in Article. 22a of the Act (except for 7.2.6).

12. Specific conditions in terms of required documents, statements confirming that the conditions for participation in the tender have been met and no grounds for exclusion and their statementsm contains the SIWZ.

13. The Contracting Party reserves in accordance with art. 24aa of the Act, that it will first evaluate the offers, and then examine whether the Contractor, whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings.

Additional information that did not fit the point. VI.3) announcements:

7.3 .If the Contractor is established or resides outside of the territoryum Poland instead of the documents referred to in point 7.2.1., 7.2.2., 7.2.3., 7.2.5. SIWZ, submits:

7.3.1 information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has its registered office or place of residence has the person concerned or a document, in-the scope specified in art. 24 sec. 1 point 13, 14, 21 of the Act

7.3.2. Document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming that:

7.3.2.1. Is not in default of paying taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of these amounts, including any deductionsfines, in particular it obtained the legally required exemption, postponement or spreading into installments of overdue payments or suspension in full of the implementation of the decision of the competent authority,

7.3.2.2. its liquidation has not been opened nor bankruptcy has been declared.

7.3.3. Documents referred to in point 7.3.1. and 7.3.2.2. SIWZ, should be issued no earlier than 6 months before the expiry of the term compositionoffer, and the document referred to in point 7.3.2.1. The ToR, should be issued not earlier than 3 months before the deadline for submission of tenders.

7.3.4. If in the country in which the Contractor is established or resides or the place of residence has the person concerned, the documents do not appear referred to in point 7.3. SIWZ, is replaced by a document containing the appropriatefor the Contractor's statement, indicating the person or persons authorized to represent him, or a statement of the person to whom the document was to be applied, filed before a notary or before a judicial, administrative or professional self-regulatory or economic body competent for the Contractor's seat or place of residence or place residence of that person. 7.3.5. In case of any doubts as to the content of the document submitted by the Contractor, the Contracting Party may contact the competent authorities of the relevant country in which the Contractor has his registered office or place of residence, or the place of residence of the person the document refers to, providing the necessary information regarding this document.

7.4. Ordering party before orderingia, will call the Contractor whose offer has been the highest rated, to submit in a period not shorter than 10 days from the date of the call - valid as at the date of submitting statements or documents confirming the circumstances referred to in Article. 25 ust. 1 of the Act.

The offer must contain:

12.8.1. completed with Annex 1 to the Terms of Reference Offer Form,

12.8.2. completed with appendix No. 2 and 3 to the ToR form. Price form-and description of the subject of the order (the Contracting Authority asks you to attach Annexes 2 and 3 to a CD or DVD).

12.8.3. completed with appendix No. 4 to the ToR SIWZ submitted in electronic form

12.8.4. Catalog or prospectus or folder in the scope of scoring technical parameters - in Polish - of the offered subject of the order containing the description and parameters confirming the requirements set by Zam. in attachment No. 3 to SIWZ and containing catalog numbers - based on which the offer has been prepared. In the catalog / prospect / folder, it should be clearly indicated which items (Appendix 3 to the Terms of Reference) apply to the given entry by including in it both medical equipment, as well as the number of the individual item assortment of the Package. The Employer allows submission of a catalog / prospectus / folder to the offer - a requestthe core fulfills all requirements described by the Employer.

12.8.5. Annex No. 6 to the Terms of Reference - third party liability (if applicable)

12.8.7. bid bond (for non-cash form)

1.In order to confirm the absence of grounds for exclusion of the Contractor from participation in the proceedings, the Employer requests the following documents onart pond 24 sec. 1, art. 24 sec. 5 points 1 of the Act and art. 24 sec. 5 points 8 of the Act:

1.1. Information from the NQF in the scope specified in art. 24 sec. 1 point 13, 14, 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders,

Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland.the document referred to above, submits the document referred to in point 7.3.1.SIWZ within the scope defined in art. 24 sec. 1 point 14 and 21 of the Act. If in a country where a person has a place of residence, whose document was to be involved, such documents shall not be issued, it shall be replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or administrative body.m or a body of professional or economic self-government competent for the place of residence of this person. The document should be issued not earlier than 6 months before the deadline for submission of offers. In case of doubt as to the content of the document submitted by the Contractor, the Contracting Authority may contact the competent organs of the country in which the person concerned is domiciledfor providing the necessary information regarding this document. At the request of the Ordering Party (in accordance with point 7.4 of the SIWZ).

1.2. Certificates of the competent US governor confirming that the Contractor is not in arrears with payment of taxes, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has concluded agreement with the competent authority pin respect of repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments or suspension of the full implementation of the decision of the competent authority at the request of the Employer (in accordance with point 7.4 of the SIWZ). the relevant local ZUS or KRUS organizational unit or otherdocument confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has made an agreement with the competent authority regarding repayment of such receivables together with possible interest or fines, in particular obtained-the right to release, postpone or install into installments overdue payments or suspend in full the execution of the decision of the competent authority at the request of the Employer (in accordance with point 7.4 of the SIWZ).

1.4. Provision of the Contractor at the request of the Employer (in accordance with point 7.4 of the SIWZ):

1.4.1. about the failure to issue a final court decision or final administrative decision on default-taxes, fees or social security or health insurance premiums, or in the event of issuing such a verdict or decision documents confirming the payment of such claims together with any interest or fines or entering into a binding agreement regarding repayment of such claims,

1.4.2. no decision on him as a preventive measure for the prohibition of applying for ordersNot public,

1.4.3. without being charged with taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716)

1.5 . Write-off from the relevant register or central records and business information, if separate regulations require an entry in the register or records, in order to confirm the lack of grounds for exclusionbased on Article. 24 sec. 5 points 1 of the Act at the request of the Ordering Party (in accordance with item 7.4 of the Terms of Reference).
