The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked in the first place in the intermediate ranking prepared at complete evaluation of bids.

1) attestations regarding absence of overdue debts on taxes, fees and contributions to consolidated state budget (local, state budget etc.) at the time of presentation;

2) criminal record of economic operators and of the members of the administrative, management or supervisory body of the respective economic operator or athose who have powers of representation, decision or control on the site, as evidenced by the certificate issued by NTC / Incorporation; -3) where appropriate, documents demonstrating that the trader may benefit from the derogation under art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement;

Requirement no. 1

Operatorthe economic ones submitting the offer must prove a form of registration according to the law of the country of residence, stating that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution and that he has the professional capacity. to perform the activities that are the subject of the contract. Modality by which it can be demonstratedfulfillment of the requirement: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation.

The bidder / candidate must have the right to provide the services provided in art. 62 point 2) of the Forest Code.

The contracting authority has the right to request the bidders, in exceptional circumstances, before the expiration of the validity period.supply quality, extension of this period. In the case of extending the period of validity of the offer, the period of validity of the guarantee for participation will be extended accordingly. The bidder has the obligation to communicate to the contracting authority whether or not he agrees with the extension of the validity period of the offer. Tenderer who does not agree to extend the periodof the validity of the offer is considered to have withdrawn the offer, without this fact losing the guarantee of participation. In case 2 or more economic operators whose offers have been declared legally, technically and economically-financially admissible by the contracting authority, have offered the lowest prices, the contracting authority will requestonly to those operators the submission of new price offers, on SEAP in the "Clarifications" section. The economic operators have the right to improve the previously offered price, following the offer containing the new lowest price, to be declared a winner.

The bidder will present a declaration by which it accepts the contractual clauses contained in the contract model from the award documentation (inotherwise it is considered tacit). In the event that there are objections to the draft contract, respectively modifications of the contractual clauses or the addition of new clauses, any proposals for modification / completion / deletion of contractual clauses will be formulated in writing with justifications and will be sent to the contracting authority respecting the terms provided by the contract. art.161 of Law 98/2016. Completion and submission of DUAE is mandatory.
