Requirement 1. Declaration regarding non-compliance with the provisions of art. 164, art. 165 and art. 167 of Law no. 98/2016 on public acquisitionshow.

The tenderers have the obligation to complete and the initial submission of the DUAE by the bidders / candidates (including associates / subcontractors / thirds supporters) as the first davada of non-compliance in excise situations(please see DUAE User's Guide developed by ANAP available at www.anap.gov.ro)

a. When submitting an offer in association, each associate has the obligation to demonstrate the fulfillment of the requirement. This statement is also requiredsubcontracting enthusiasts. In the case of submission of an individual / joint offer that is technically and professionally supported by third / third supporters, each supporter has the obligation to prove the fulfillment of the requirement.

The classification in one or more of the situations provided in art. 164, art. 165 and art. 167 of Law no. 98/2016 on public procurement, entails the exclusion of the tenderer from the procedure for awarding the contract; The bidder ranked first after applying the award criterion on admissible bids proves non-compliance with the exclusion, by submitting at the request of AC, as a rule, the following information and documents:

- certificates regarding the lack of debts, regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of the presentation,

the criminal record of the economic operator and the members of the management body, its managementthe supervisory authority of the respective economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, - as the case may be, documents proving the fact that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Law-98/2016 on public procurement, - other editorial documents, as the case may be, - if in the country of origin or in the country where the economic operator is established, documents of the type requested are not issued or they do not cover all situations contained in art. 164, art. 165 and art. 167, any document deemed to be edifying by the competent authorities of that country shall be accepted,

- in the case of foreign legal / natural persons, the documents will be transmitted in the language in which they were issued, in a certified copy "according to the original", signed and stamped by the legal representative, accompanied by a certified translation in Romanian.

Requirement 2. The bidder, the associated offeror, the subcontractor, the third party and the members of the management / management bodyrequesting / supervising / with power of representation, decision or control within the bidder / associate / third party / subcontractor must not be in the situations provided by art. 60 of Law 98 / 2016.

Means of performance:

1) If several offers were declared admissible by the contracting authority and ranked first and have equal prices, the authority accountthe reviewer will ask for clarifications through SEAP for the electronic loading by new operators of new documents containing new prices. If for technical reasons exclusively related to SEAP technical performance it is not possible to transmit in electronic format through SEAP, the respective documents shall be transmitted to the contracting authority in the written form in p.2) The bidder will submit a statement accepting the contractual clauses contained in the contract model in the tender documentation. If there are objections to the proposed contract, modifications of the contractual clauses or the addition of new clauses, any proposals for modification / completion / deletion of contractual clauses will be written in writingu justifications and submitted with the qualification documents. If the proposals are disadvantageous to the contracting authority, it reserves the right to reject them by informing the tenderer. If the tenderer does not waive these clauses, the contracting authority will enclose the offer as non-compliant and will reject it;
