The way to prove the fulfillment of the requirement:

- The DUAE will be filled by the economic operators participating in the award procedure with the information related to their situation. demonstrate the fulfillment of those assumed by completing the DUAE to be presented, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

These supporting documents may be:

1. • certificates of absence of RESERVE debts regarding the payment of taxes, fees or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment p2. the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator, or of the persons having the power to represent, decide or control it, as it results from the founding certificate issued by the ONRC / constitutive document; 3. • as the case may be, documents demonstrating that thethe economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; 1

The economic operators submitting the tender must prove a form of registration under the law of the country of residence, from which it appears that the economic operator is legally constituted, that it is not located in any of thethe cancellation of the establishment and the fact that it has the professional capacity to carry out the main object of the contract.

Way by which the fulfillment of the requirement can be demonstrated:

- the DUAE will be filled in by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillmentof those undertaken by completing the DUAE, respectively the certifying certificate issued by the ONRC or, in the case of foreign tenderers, equivalent documents issued in the country of residence are to be presented, at the request of the contracting authority, only by the tenderer ranked I in the intermediate rankings drawn up at complete the evaluation of the offers.

The information in the certificate must beit's REALLY / VALIDED AT THE TIME OF THE PRESENTATION.

Requirement no. 2

The tenderer / candidate must have the right to provide the services provided under Art.62 (2) of the Forestry Code.

Required documents:

Validity of the offers 90 days from the deadline submission of tenders.

Notes:

a) The Contracting Authority has the right to ground(b) the tenderer has the obligation to communicate to the Contracting Authority whether or not it agrees to the extension of the period of validity of the offer. (c) the tenderer shall, in exceptional circumstances, who disagrees with the extension of the offer's period of validity is considered to be withdrawingI would like to offer, without this losing the guarantee of participation.

d) The language of the offer - Romanian. All certificates and documents issued in a language other than Romanian will be accompanied by their authorized translation in Romanian.

If the economic operators participating in the award procedure use the rights provided for in Article 193 of Law 98/2016 through comthe justifying documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, only by the tenderer placed in the 1st place. e) The clarification requests of the potential bidders will be addressed exclusively in SEAP at The "Questions" section of the award procedure conducted by electronic meansonice and the responses to them will be published in the SEAP, at the "Documentation and Clarification" section of the tender notice, the contracting entity not to respond to the requests addressed by another means of communication than the one established according to the provisions of art. 64 par. (1) of the Law no. 98/2016 for further posting of tendersevaluation will submit requests for clarification of submitted offers in SEAP to the "Questions" section. The economic operators will submit the answers to the clarifications and any requested documents during the evaluation of the offers through SEAP (Section "Questions"), fully in the section corresponding to the respective request, in the form of one or more documents / files-signed with extended electronic signature.

g) If it is found that the first ranked offers have equal scores, the winner will be the winner with the lowest price. If the offered prices are equal, in order to divide the bids, the contracting entity (through SEAP in the "Questions" section) will request the re-presentation, by presentinga new financial proposal. The new financial proposal will be submitted only after the request of the contracting entity.

H) The tenderer will submit a statement accepting the contractual clauses contained in the contract model in the tender documentation. If there are objections to the respective draft contract, modifications of the contractual clauses or the addition of some clauses, new proposals, any proposals for modification / completion / deletion of contractual clauses will be formulated in writing with justifications and submitted with the qualification documents. If the proposals are disadvantageous to AC, it reserves the right to reject them by informing the tenderer. If the bidder does not give up these clauses, the AC will place the offer as non-compliant and will reject it. I) In the case of ar contracted situations the contracting authority may amend the contract on the basis of Article 221 of Law 98/2016. The contracting authority wishes to benefit from the reduction of the period for submission of tenders in accordance with the legal provisions.
