The contract, subdivided into n. 266 lots, has as its object the signing of a Convention pursuant to art. 1, paragraph 4, of the L.R. n. 33/2007, for the supply of Thermochemical Cards, as well as the provision of related services in favor of the Administrations and Entities referred to in paragraph 4 of the art. 1 of the L.R. n. 33/2007, as better described in the tender documents.

Main Site: At the offices and premises of the regional health service bodies pursuant to art. 1 of L.R. n. 30/2006 that will accede to the Convention.

The contract has as its object the signing of a Convention pursuant to art. 1, paragraph 4, of the L.R. n. 33/2007, for the supply of Thermochemical Papers, as well as the provision of connected servicesi in favor of the Administrations and bodies referred to in paragraph 4 of the art. 1 of L.R. n. 33/2007, as better described in the tender documents.

In case the exclusion from the tender as essential elements of the offer, each competitor must satisfy, also in accordance with the provisions of the tender regulations, the following conditions:

a) registration for activities concerning the subject of this contract della C.C.I.A.A. or in the register of the provincial commissions for the craft in accordance with the provisions of paragraph 3 of art. 83 of Legislative Decree 50/2016;

b) there are no grounds for exclusion pursuant to art. 80, Legislative Decree no. 50/2016 (in the case of R.T.I. or Consorzi, see the provisions of the tender regulations).

1) The tender procedure is managed with the telematic system called Sintel, accessible from the website www.arca.regione.lombardia.it, whose description and mode of use for the purposes of presenting the offer and specified in the tender regulations and related annexes as well as in the technical manuals available on the website www.arca.regione. lombardia.it.

2) The specific provisions concerning supply and related services, presentation methods and elements of vthe offer, the single auction bases which can not be exceeded at the time of the offer, under penalty of exclusion from the tender, the subcontracting, the other exclusion causes and the other tender information are contained in the tender regulations and related attachments. The individual Supply Contracts, implementing the Convention, stipulated by the Contracting Administrations by means of Supply Orders, haveduration equal to the duration of the same Convention, consequently, the orders issued will expire at the expiration of the aforementioned agreement or at the exhaustion of the requested quantities.

3) The modalities of participation in the case of a temporary grouping of companies, in the case of aggregations between companies participating in the network contract, and in the case of a consortium are governed by the Guidelinesra.

4) The participation of competitors who are among themselves in one of the control situations pursuant to art. 2359 of the Italian Civil Code or in any report, even de facto, if the control situation or the report: i) implies that the offers are attributable to a single decision-making center, (ii) has influenced the formulation of the offer. They will also be excludedi from the tender the competitors for which it is ascertained that the relative offers are imputable to a single decision-making center, on the basis of univocal elements.

5) Partial and / or conditional bids are not allowed as specified in the Competition Regulations and Attachments.

6) The competitors, with the submission of offers, allow the processing of their personal data, pursuant to Legislative Decree nos. n. 196/2003 s.m.i., for the competition and contractual requirements.

7) Information and clarifications on the tender documents can be requested according to the procedures indicated in the tender regulations, no later than the deadline of 25.3.2019 Time: 12:00. The clarifications to the tender documents will be communicated / published with the procedures referred to in the Disciplinare di gara.

8) Competitors are required to entercare, during the presentation of the offer, the domicile elected for the sending of communications, noting that the same will be sent by ARCA S.p.A. with the methods indicated in the attachment above.

9) Dr. Carmen Schweigl was designated as the Procedure Manager for this procedure.

10) In the scheme of the Convention the ordering modalities will be indicatedelectronic invoicing and electronic payment are regulated.

11) Subcontracting is permitted within the limits established by art. 105 of Legislative Decree 50/2016 with the obligation to indicate the provisions of the co. 6 of the art. 105 during the presentation of the offer.

12) The possibility of increasing or decreasing contractual performances up to the competition of a q is allowedthe maximum contractual amount to the same agreements, prices and terms of the same (variation of 20% of the total auction base of EUR 7 718 433.19, VAT excluded) and the contractual extension in case of non-erosion of the quantities in the validity period of the Convention.
